    Most state real estate commissions and departments have long had a rule which restricts real estate advertising to "newspapers" and publications owned by brokers. In 1991 or 1992, when I created the Real Estate Center on America Online, I had my attorney contact three states with such rules to ask if it would be lawful to have an online display of properties for sale (in effect, one of the first online MLS systems). As we did not charge to post listings the answer in all cases was yes. However, within our letter was a clear statement referencing First Amendment rights and the idea that the Internet was merely a technological extension of print media.

    We believed the rule was impossible to enforce, especially since the Supreme Court had struck down professional advertising bans in the 1970s. It's difficult to imagine a state attorney general defending such a regulation.

    That is the only leverage the borrower has. With foreclosures often taking a year or more, and with the financial outcome of a foreclosure unknown, lenders are increasingly accepting short sales.

    The bank wants the highest possible price because that will produce the smallest possible loss. If the loan were being fully repaid the bank approval would not be required.
