Normally the bank would take over or foreclose the property and get a new developer to straighten things out. The owner has an interesting tactical possibility. He can declare bankruptcy using a Chapter 13 or Chapter 11. He can then get the current value of his holdings (most likely less than what the bank is owed) and have five years to pay the bank off in full. He needs to talk to a bankruptcy lawyer.
