Our nation is only great because lawyers are allowed to file untold numbers of frivolous lawsuits, hoping that a couple will pay off and a handful more will be good for extortion value.
The fact that standard legal process forces the "opponents" into ruinous legal fees and holds them hostage for the duration of the lawsuit is of no concern at all, because it employs a whole 'nother set of lawyers who get to churn fees. The lawyers have no responsibility at all for the expense and harm they inflict, it is just part of doing business, ruining lives and fortunes to try to get a windfall. Besides, it holds great intimidation value for said extortion.
"Discovery" is another term from the code of civil procedure that gives lawyers unlimited license to harass and run up outlandish bills without reservation.
Arbitration is a horrendous crime because it diminishes this sacred extortion and frivolous lawsuit right of the legal profession.
After all, everybody should be involved in several pending lawsuits at a time so that our country and its justice system can continue to be great. Who needs local criminal protection and extortion rackets when we have licensed government officials who perform this valuable social function?
Maybe 94 percent of arbitrations don't receive anything because, like the bulk of lawsuits filed, 94 percent of the claims have no merit on their face.
