He could have done the same based on data from terrorism analysts without raising a tenth of the attention this got.
But that's assuming the whole point wasn't in fact to create a PC shit storm.

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof..."

That's about Congress, and laws.

Not about the president's clearly stated right to restrict entry of aliens, who are not even citizens.

The First Amendment not only allows citizens the freedom to practice any religion of their choice, but also prevents the government from officially recognizing or favoring any religion.

Discriminating against one religion clearly favors others.

Establishment Clause has been found not to apply in other cases regarding immigration.

The SCOTUS has traditionally been loathe to restrict the Plenary Power Doctrine of the Government.

Persecuted Religious minorities being explicitly considered grounds for asylum/refugee status are all over the USC, in Treaties that are the Law of the Land because the Congress has voted them in, in other International law, and much more.

So by tossing that, essentially any persecuted group inside a country currently banned could not be made exceptions for, which makes a joke out of defining refugees.

Other parts of the US Code say the Government can discriminate right down to the level of areas WITHIN a foreign country, or persecution from Non State Actors.

If 9th Circuit (the most overturned court in the country, btw) upholds it, it would essentially be impossible to make exceptions for persecuted Falun Gong or Catholics if you banned Mainland Chinese from entering the USA. Or, if this was WW2, admitting JWs or Jews or dissident Priests being persecuted by the Nazis if you banned 3rd Reich citizens from immigrating.

If you took it to it's logical conclusion, even banning by nation-state might be an offense: "Discriminating in regards to National Origin."

Of course, the end-game is a borderless world established by multilateral treaties where powerful multinational corporations can do as they please without restriction.

As the Boston Federal Judge who refused to extend the original injunction (something the media glosses over and commits half-truths with this important ommission) hours before Robart the Feminazi Rape Culture Symp imposed it for Washington without any written explanation,

What counts is what's in the EO. It'll be a helluva slippery slope if the Courts have to consider Campaign Rhetoric in making decisions about curtailing the President's immigration and foreign policy decisions which traditionally the courts have been extremely loathe to do.

Section 5 only makes exceptions for persecuted religious minorities. In Syria, that means Druze, Alawites, Shi'a as well as Christians. Why? USC Code says non-state actors can be source of persecution.

Very dangerous precedent! Forbids the governement from banning a nation state persecuting a minority, from making an exception in defiance of all international law and other parts of the USC, for those being persecuted. Totally ridiculous and a major impediment to Foreign Policy and the globally undisputed right of Parens Patriae.

It would be... Unprecedented.
