As the NYT reported in the Elian Gonzales case, you can't have the courts guessing the Foreign Relations and Immigration Authority of the President, either intrinsic to the office or expressly granted to him by Congress.
At least 11 times, the opinion by Judge J. L. Edmondson of the United States Court of Appeals for the 11th Circuit suggested that the Immigration and Naturalization Service might have made wrong decisions in the case. But, Judge Edmondson wrote, it was not the job of judges to overturn the policy ''selected by the I.N.S. merely because we personally might have chosen another.''
The opinion, in language that could come from any Republican platform of the last 20 years, concluded: ''It is the duty of the Congress and of the executive branch to exercise political will. Although courts should not be unquestioning, we should respect the other branches' policy making powers. The judicial power is a limited power. It is the duty of the judicial branch not to exercise political will, but only to render judgment under the law.''
...He said the court probably went further than this case demanded in emphasizing how immigration policy affected ''the president's conduct of our nation's international affairs.''

Word on the ground in Texas...I'm hearing rumors of regular working illegals being asked for documents, and sent home regardless of criminal history. My local mexican market is having problems keeping a consistent staff in their taqueria kitchen and meat market.
If Trump is not doing anything wrong, how come he cannot come up with a simple clear answer to basic questions. I listened to Miller getting interviewed on Meet The Press yesterday, and it was like getting teeth pulled. I know many politicians answer the question that they wish they were asked instead of the question that was asked, but most come close to answering the question.
Miller said that they were going to deport criminal illegals to help protect Americans. Then, when asked what constituted a criminal illegal (would just being here illegally constitute a criminal act?), he would not answer. He just said that it would be improper to tell a ICE agent not to enforce the laws. If you are proud of your directives and feel that they are right, you should just communicate those directives clearly. I hate listening to most of Trump's spokespeople for this reason.

The stories I am hearing suggest the police are asking for ID with no probable cause, and sending any undocumented worker back. This is unnecessary and its hurting local businesses. Quote from local market owner, "I have jobs for which no Americans apply. I am paying more than minimum wage, the americans still dont want this work." Seems like a waste to send these people home

Refusing to answer questions with no "correct" answer is just wisdom. Jesus did that quite a lot, answering "gotcha" questions with another question that delves into the questioners motivations.

In fact the NYT used the "some concern" to express their opinion in a News Article that Reno wasn't using enough force.
