Age of consent in CA is 18. BTW, parents have responsibility for their kids until age 18, so any policy proposal in this area will involve parents too. A better rule might make the adult strictly and primarily liable for any actual direct consequences, e.g. pregnancy or STDs, but reserve criminal penalties for cases that lacked informed consent (e.g. lying about STD status).

You are right that calling A=B=C, where B is actually really Bad and the others aren't, has the effect of trivializing B. That puts a lot of power and responsibility in the hands of judges, and there do appear to be sentencing disparities where adult males are treated worse than adult females in these cases. Part of that may reflect political activist organizing, especially where judges are elected.

Thoughout the USA, laws tend to get written and maintained on behalf of political action committees, via lobbyists and a revolving door. (The reverse can also happen, where a legislative committee can threaten to change the law governing a particular industry, as a way of extracting campaign finance or other favors from that industry.) With regard to criminal laws, the prison industrial complex (including not only private prisons but also the companies that supply products and services to prisons) cooperate via ALEC. They aggregate constituencies via fake grassroots campaigns, etc. The current legislation in any field tends to maximize the revenues of the industries whose represenatatives wrote it, just as Obamneycare maximizes medical spending and American foreign policy and "defense" policy promote the MIC, and of course the endless "drug war".

I wish I could elaborate, but you guys are very wrong when it comes to Males >18(really more like males >25yo though) and females that are 14-17 yo. The crazy thing is...a friend did bang one of the teachers. But she was bright enough to wait until he was 18 before doing anything. Which really is the issue right now. I'm not sure the laws need to be changed. Rather the adults need to exercise better judgement. None of us are stupid enough(I don't think) to even put ourselves in a situation where tapping out a minor is even a possibility.

And, your second sentence suggests you had either a very unusual high school or a limited circle of guys you knew there.

I don't quite understand how this is a response to my statements. I'm clearly speaking to "older" as in 25+ men and dealing with under 18 year old girls, which is exactly what current laws are supposed to protect against. Everything else starts to get into shades of grey hence the need for judgement from the legal adults ages 18 or older. As to the exception of minors passing as older, again that falls to the judgement of the legal adult.

Unless your definition of "judgement" includes requiring at least two forms of ID and notarized affidavits, I think it responds directly. Most criminal laws require intent, i.e. mens rea, in addition to action. For example, if you pick up an umbrella reasonably believing that it's your umbrella, then that isn't theft, but if you knew it wasn't yours, then that's theft. If you go to a 21+ bar and meet a female with large breasts and her fake ID says says she's 22, it would take more than reasonable judgment to know her ID is fake and she's only 17. Eliminating the intent element requires clairvoyance, not judgment.

Depends where. You live in Florida, where too many Americans get fat and smoke and get too much UV exposure, and let themselves go. That probably affects your views on medical costs, for example. Look at other places, where people are healthier and look better for a lot longer than most Americans. Smoking, alcoholism, obesity, and sun exposure can age people much faster than they would age normally. Tattoos can compound that, btw, especially when people get so many they interfere with liver function. Apparent age can vary more than a decade depending on genetic and environmental factors.

That may all be true, but I'm pretty sure Kate Beckinsale won the genetic lottery and is slightly outside the bell curve for a 40-something-year-old woman.

Yes, but that reason is evil and a travesty of justice. The real reason its called statutory rape is to make a false equivalence to actual rape. It is to prejudice the jury and the judge against the defendant by invoking a visceral reaction by calling the defendant a rapist. Emotion should play absolutely no role in juries and sentencing, but law makers use emotional manipulation to get what they want. Judgement, especially legal judgement, should be dispassionate and objective. That is the only way to serve justice.

If a 15-year-old cannot consent to have sex with a 20-year-old, then that 15-year-old cannot consent to have sex with another 15-year-old, and thus all sex under 18 would be rape. This is a ridiculous notion. It is even more ridiculous to think that two immature minds deciding to have sex is better than one mature and one immature one. At least the older party would bring some responsibility to the relationship say by insisting on using condoms.

The hypocrisy of our legal system is demonstrated every day by these cases. The public wants to prevent older men from having sex with younger women, not out of concern for the women, but simply because human beings have always tried to control who has sex with whom. It's human instinct left over from when sex and reproduction were strongly tied.

However, the courts have realized that unless they slap women's wrists they leave themselves upon to legal attacks that prosecuting men violates the equal protection of law. The courts have absolutely no interest in prosecuting women for the same crime, which should not be a crime, but they make a show of it so that they can really prosecute men. This is why women get commuted sentences and men get decades in prison.

Recently someone posted that a woman who falsely accused a man of rape was given a commuted sentence when the man had lost four years of his life in hard prison. That's fucking ridiculous. It is a war on men, and it is vile.

It is true that magazine images are heavily photoshop. However, so far there is no real-time automatic photoshopping of video, and Kate Beckinsale still looks beautiful when she goes on late night show interviews. Yes, makeup and cosmetic surgery and other tricks may play a part, but even with all that, she's aged far more gracefully than most women can even hope to do. It's the luck of what genes your born with. Some people just age more slowly than others.
