If an employer ever offers you VitaFlex for any reason, like transit reimbursement, stay away from it, and find a different employer too, because any employer that would use VitaFlex clearly either has no idea what they are doing, or hates their employees.

If you change employers, they simply steal your balance at any time of the year. This is not disclosed when you sign up.

Unfortunately, when your employment with N ended, your account was closed and the debit cards were shut off. The funds in your account were only available for transit services being provided so you could commute to and from N. Please be aware that because these funds were deducted on a pre-tax basis, they cannot be reimbursed to you.

This happened to me too. No disclosure, just theft of the funds.

Do we have basis for a class action suit?

Vitaflex tried to post the outright lie that I was notified that they would steal the money if I changed employers.

I spent a good hour searching for any hint that they would steal the money before I signed up. I remember this very clearly and was careful about it because of the "Flex" in the account name.

There was absolutely zero notification that they would steal the money. Nor was it even discoverable with an hour of searching.

Vita is happy to provide copies of all the notices that were provided to you that specifically state what happens to your funds when your employment ends. We can also provide the exact dates and times these notices were provided.

As it was mentioned in our previously deleted response, the enrollment in this plan is not required. It is a voluntary enrollment where each employee chooses if they want to participate and how much they want to contribute from each paycheck on a pre-tax basis. Employees can stop participation at any time.

Oh yes you can. Once you leave employers, you absolutely can roll over your 401k to another one.

Yes, it's exactly like that. Vitaflex sucks and everyone should avoid it.

With a 401k you can indeed rollover.

But Vitaflex simply fucks you without notice.

Hopefully this post will help some employees the pain of getting scammed by Vitaflex. How many thousands of innocent employees have lost money this way? Class action suit sounds very good to me.

In addition, Vitaflex's website deliberately hides the option to cancel contributions to Vitaflex. It it literally invisible on their website, and you have to call their help line to find out how to cancel. (Click on the blank background of a certain page.)

Vitaflex is a scam from start to finish.

They claim they sent emails with one confiscation sentence hidden towards the bottom in the fine print. But first of all, I never received them, probably because they used the wrong email address to begin with.

Secondly, email is not a valid way to legally notify anyone of anything:

No, generally email does not constitute valid notice unless: (a) you can prove that the person actually got it and read it, typically because they have admitted to it or responded to your email, (b) you have agreed with them in advance that emailing them qualifies as notice, or (c) less commonly, there is a statute on point that says that email notice is okay. It's a poor form of notice, because lots of email gets deleted, lost in people's spam filters, bounces, etc.

It’s silly too, because you can already write off travel expenses. Why do you need a company to hold your money?

I’d sue. I think you definitely have grounds.
