SB1424 is brief. Read it:

This bill would require any person who operates a social media, as defined, Internet Web site with a physical presence in California to develop a strategic plan to verify news stories shared on its Web site. The bill would require the plan to include, among other things, a plan to mitigate the spread of false information through news stories, the utilization of fact-checkers to verify news stories, providing outreach to social media users, and placing a warning on a news story containing false information.

(a) Any person who operates a social media Internet Web site with physical presence in California shall develop a strategic plan to verify news stories shared on its Internet Web site.

(b) The strategic plan shall include, but is not limited to, all of the following:

(1) A plan to mitigate the spread of false information through news stories.

(2) The utilization of fact-checkers to verify news stories.

(3) Providing outreach to social media users regarding news stories containing false information.

(4) Placing a warning on a news story containing false information.

(c) As used in this section, “social media” means an electronic service or account, or electronic content, including, but not limited to, videos, still photographs, blogs, video blogs, podcasts, instant and text messages, email, online services or accounts, or Internet Web site profiles or locations.

Given the costs of real estate (I'm sure commercial or land for server buildings is high as well like residential) in CA being so high, are there that many web sites "physically" sitting in CA on a server? This seems kind of like a stupid plan given the relative ease in moving a web sites information to another physical location. Businesses will just move the "site" to another state in order not have to deal with one of the dumbest laws/regulations I maybe have seen in a while.

Look to short REIT's that are heavy in tech/server commercial property in CA if this goes through. I don't know of any, but I'm sure there's a special REIT out there for that type of thing.

It's either San Fran or New York based on the hosting info. So 50/50 shot or so I believe. Either way, switching to servers in a different state is pretty trivial. A lot easier then having to comply with some dumbass regulation.

I don't see how that bill could possibly stand, since it would be a clear violation of the first amendment:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.


This would totally be an abridgement of freedom of speech and of the press.

The important thing is that everyone in the Sacramento area vote against CA state senator Richard Pan from now on.

This is what the Constitution was made for. This proposed legislation would have the government limit free speech. That is unconstitutional based on the limitations placed on the government under the first amendment. The people now see how much contempt Richard Pan has for the Constitution, it is time to RECALL HIS ASS! He is trying to subvert the constitution, we cannot let him do this.

It's bad. I'm still hung up on "physical presence." What does that even mean? If your corporate HQ is in CA you have to do this? Or is it literally the physical location of your severs and the data? What about sites that are hobbies that there's no revenue generated and it's not even a business? It does say "person" in there.

I don't know this politician, but this is so poorly written it's alarming that they got elected. Or if he has staff they're incompetent.

I mean, what are the criteria for proving "truth", say of a particular interpretation of certain events. What would be the criteria to determine "truth" or "falsity" of some interpretation of the RFK assassination? If someone suggested the CIA was behind it thru Palestian agents it controlled, would that be sanctionable under the law if the site that hosted such comments did not "examine" it and post appropriate warnings?

It really seems that the whole purpose of the law is to further burden the expression of free speech, forcing it into channels acceptable to the powers that be. Or just to chill the expression of speaking generally other than in official and corporate channels.


Yes, looks like our corporate owners want to reserve the definition of "truth" for themselves and prosecute truth that they don't want to hear. No other opinions allowed.

Yes, anyone running a business is much more intelligent than anyone in the government and businesses will move or find another way around it.

Why doesn't California just create a state-run news network so the residents can be told exactly what to think? All other sources of news that don't agree would be considered hate speech.

I wish. Opinions can still vary, but Americans need to learn that there is such a thing as true facts.

If the facts aren't known for sure, then that's a fact, and it's okay. But the current polarization we have with half the population being totally cool with a President that lies constantly, is major (dead) canary in the coal mine (so to speak).

The polarization issue would be fixed by:

1. stopping the export of US jobs to countries without labor or environmental jobs (tariffs can help with this)
2. stopping the import of illegal aliens who are brought here specifically to lower wages and benefits for poor US citizens

The left has become anti-labor, ironically. Long ago, they supported labor against capital. Now they have abandoned labor and concentrate only on non-issues like tranny bathrooms.

This is so dishonest. The left failed to stand up against corporations as labor slowly got fucked over (destroying private sector unions, private sector pensions, and the onslought of outsourcing). BLaming the left for not preventing all of this is disingenuous.

THe left have still stood up for labor that works for the government, but all the other gullbilbe right wingers HATE that and want to see government compensation lowered, which is nothing more than the next step towards lowering labors compensation everywhere in the U.S., by removing the competitive options that labor has of being payed decently for government jobs.

3085. The Attorney General shall, not later than April 1, 2019, establish an advisory group consisting of at least one member of the Department of Justice, Internet-based social media providers, civil liberties advocates, and First Amendment scholars, to do both of the following:

(b) Draft a model strategic plan for Internet-based social media platforms to use to mitigate the spread of false information through their platforms.
