Why does she need to resign? How would she put the country in crisis if she suddenly becomes very ill?

You can suggest to put an 80-year old cap on all government officials, but she would get grandfathered in. You don’t change the rules half way through the game. That’s not how life works.

I didn't say we needed a law tomorrow, but we SHOULD have a law going forward.

Announcing she is going to step down on X Date takes much of the pressure off finding and nominating a replacement, it's much better for the country than a sudden health issue and all the disagreement and delay that will result from a sudden death.

In any case, she is so sickly it is farcical for her to go on, no matter how "Mentally with it" she may still be. Enjoy the Farce! I for one have pity on her, she is clearly pushing herself beyond all reason for political purposes.

I also recall Chris Cilizia saying 100s of McCain's Medical Records weren't enough, and being dubious of Trump's health, even though the man does 3 rallies in a day when campaigning.

WASHINGTON – Supreme Court Justice Ruth Bader Ginsburg was not on the bench on Monday to hear arguments in the first case brought to the high court since the 85-year-old underwent cancer surgery last month.

Ginsburg has not missed a day of argument since President Bill Clinton appointed her to the bench in 1993. This is believed to be the first time she has missed a day for any reason outside of recusal.

When the Founders wrote the Constitution which enshrines the rules for justices, there wasn’t much for medicine available. Certainly there wasn’t the medical industry that we have today which can keep a failing body on life support with heroic interventions for weeks or months, and can add years to the lifespan of an oldster who really should have died of “natural causes.”

An update is in order, and shouldn’t even be political. But you are correct, RBG should be grandfathered in.

There was age limit for faculty appointments until late 1970's - you had to resign when you hit 65, which is a good idea (perhaps adjusting it to 70 or so) as mental capabilities decline with age and consequently most older people can not teach students as well. However, in the era of political correctness and anti-discrimination this "ageist" rule was removed, and now students have a privilege of being taught by a senile, 80-year old tenured incontinent geezer who won't retire. Paradoxically, the smarter and more successful faculty do retire at 70 or so - it is losers who hang around.

Trump Admin already preparing a short list

The White House "is taking the temperature on possible short-list candidates, reaching out to key stakeholders, and just making sure that people are informed on the process," said a source familiar with those conversations, who spoke on background given the delicate nature of the subject. "They're doing it very quietly, of course, because the idea is not to be opportunistic, but just to be prepared so we aren't caught flat-footed."

Ginsburg had a pulmonary lobectomy, the Supreme Court said in a statement, and her doctors said that post-surgery there was “no evidence of any remaining disease.” She has also recovered from several past health scares. But her departure from the Court would allow Trump to nominate a third Supreme Court justice — the most in one presidential term since President Ronald Reagan placed three judges on the highest court during his second term.

The nine-member court is currently divided 5-4 between its conservative and liberal wings. Ginsburg’s departure would allow Trump to create the Court’s strongest conservative majority in decades, a scenario sure to bring intense opposition from Democrats and liberal activists still furious over the October confirmation of Justice Brett Kavanaugh.
