The court system is not unified by "The Law". It is gulag of taxpayer funded franchises for fleecing and hounding the public. "Abuse of discretion" is one of the most common phrase you will read in the appeals decisions. It means that judges are a pretty much doing any fucking thing they feel like, with an occasional lip service to the law.

They take out the garbage in the criminal justice system and for this they get open season on everything else. The goal is to wring maximum legal taxation from anything resembling a dispute. Make sure as many parties are impoverished by legal process as possible, then, they are powerless and the courts can do anything they want with them.

Exactly...which is why they don't bother with poor people.....You can't get blood out of a stone.
