I have a bunch of chimneys who moved into the apartment below me and they are making my life miserable. However, it looks like a legal precedent has been set that will kick landlords right in the nuts!

Condo owners win secondhand smoke case

An Orange County jury has found a homeowners association negligent for failing to resolve a secondhand smoke dispute between neighbors at a Trabuco Canyon condominium.
After a five-week trial, Superior Court jurors last week awarded a family more than $15,000, finding the condo association and management failed to ensure the non-smoking family's right to the "quiet enjoyment" of their own unit.

I did not know it was possible to have "quiet enjoyment" in a condo or apartment complex.

I have been an on again and off again smoker for most of my adult life. When I do smoke it's outside only.

That being said, these Nanny bastards need to leave outdoor smokers alone. The alternative for them is going to be, smoking indoors in a hiding spot. Like while they are in a bathroom stall where it can't be proved it was them that actually smoked the cigarette. Unless Bloomberg would support cameras in bathroom stalls as well.
