I went through a "sobriety checkpoint" in Santa Cruz one summer afternoon, I think it was on Water Street. I was driving someone somewhere.

So the cop asked me "did you have anything to drink today sir?" "No"

"Nothing at all?" I didn't answer him.

He asked me stuff again and I looked at him and said "I answered you before."

They want to engage you so they can say they "smelled alcohol" on your breath (Note: you cannot smell alcohol. that "wino breath" is actually ketones and other chemicals that result after alcohol goes through your system.)

He then explained he was just trying to do his job, protect the community, etc. etc. and he said goodbye.

I hate this type of shit. My sister was a county prosecutor here and we have no refusal breathalyzer stops. I don't condone drunk driving at all, but it's a cover for finding all sorts of other shit. It's literally a revenue generator. She said this herself. She moved on to another job, but if the revenue is there, it's a whole hell of a lot easier to ask/get a raise do this type of shit.

What is necessary for police to investigate is usually a “reasonable suspicion” that a crime has occurred. If that has happened you have to show ID when asked. An example would be that your breath smells like alcohol, your eyes are watery and bloodshot, and your speech is slurred. In that case a cop has a reasonable suspicion you are committing a crime and can investigate. You have to show a n ID when the cop asks.

In the video you show, the guy has not done anything to give the cop reasonable suspicion a crime has been committed and should be allowed to continue on his way without showing ID.

I’ll note as I have many times before that it’s often better (and safer) to comply with the cops orders and deal with things later via court, complaint, or lawsuit.

What is going on at the checkpoint is a pseudo consensual encounter. That is, the citizen is speaking to the police of their own free will. I say pseudo because the impression left on the citizen is that they are required to talk to police. It’s all pretty crappy because clearly the cops aren’t actually treating it as a consensual encounter.

supposedly you have a freedom of speech and right to bear arms, and freedom of religion and press.

in reality those are often oppressed by lynch mobs.
- if you can't carry a gun concealed, you have no right to bear arms.
- if you can't speak up against government policies that CA engages without being fired or retributed against you don't have freedom of speech.
- if your faith is prosecuted by government that supports lgbt groups, you dont have freedom of religion.
- if your media organization is assaulted by government or their connected friends, for speaking against it, there goes freedom of press.

So far just like no rights California paradise.

The police can detain you if they have "reasonable suspicion" that you are part of a crime. I think there is a time limit in general (20 minutes ?) based on how much time the police can detain you prior to deciding to arrest and charge you for a crime. I believe that during detainment they can ask to see your identification.

I did that once in Imperial Beach, got pulled over by cops immediately on a side street. Just didn't want to wait in line. Was given zero explanation for why I was pulled over.

If you are wasting a cop's time by not giving him ID on request, you are delaying the time between him and the next donut. This is an offense calling for summary execution.
