So every mobile phone use would pay this tax, whether they text or not.

they'll find ways to tax everything else a little more. all you need here is a proposition on a ballot that says that it's going to help struggling poor, instant pass.

This is mob rule where majority can choose to tax and take away rights from everyone with just a single vote.

Update: the FCC (headed by a Trump appointee) has said that states do not have the power to tax text messages. The California bureau has abandoned their upcoming vote on this issue in response.

Kavanaugh has already shown he will rule according to law and keep revenge or politics out of it. In this case, I think the law is very clearly on the side of the FCC.

That law would directly police free speech of individuals on social media. As such it’s unconstitutional on its face. I wouldn’t even bother trying to comply with it as it won’t be around long before any judge anywhere (other than a Leftist Constitution-hating judge who should all be defrocked immediately and then hanged for traitors) would strike it down.
This law can’t possibly survive federalism. So ignore it like gun owners of New Jersey ignore their stupid gun laws.
