The African American who had a cell phone recording in his right hand was the first to throw a punch or engage in physical contact.

I wonder if the white dude who got first punched said something real offensive to trigger the black dude. I would not put it past something like that happening.

Still the black dude should be charged with assault. And he did not look homeless. So probably could find him at his place of work or at his home.

If someone would come to a person and say "you are a fucking prick" I would think that hitting the rude person in mouth would be perfectly justifiable.
I do not know about the situation in original post because I do not know what was said/done before the assault.

I had a cop tell me that during a seminar.

It does check out, fighting words aren’t protected. Otherwise you can stand on the corner calling everyone a faggot, and sue if they punch you.
