Not enough information. Who's "David Leavitt"? Why "Tori" needs to go on vacation on public's dime?

CA has a similar law: if the item is marked with a certain price it must be sold at that price. Did he substitute the sticker or the sticker is legit?

In MA, you have to sticker every single item - at least 20 years ago - I was a Store Manager in Boston. Everything, including each eyeshadow and ketchup bottle and fan box. There was a sticker in the back of the display, clearly an inventory control sticker, that said "0.01 - DISPLAY", and he claimed a penny was the "price". Even called the cops.

I see. Looks like CA is different: there is no mandate to label every item so that sticker on the shelf is usually the only place where the price is indicated.

Does anyone know how the CA law works for pricing?

I was recently in an O'Reilys auto parts store, and their checkout counter had about 10 cans of brake cleaner, and underneath it, an advertised price of $2 a can. I grabbed a couple, and then when I got home noticed they charged me full price. I went back, but they refused to honor the price because the $2 was for a different upc code and item description (the tag did describe a different item, but it was in very small text, so very easy to mistake).

Anyway, in this case, it was the ONLY item on the entire 8 foot wide checkout counter. It wasn't like the normal shelving in the store where they have 20 different items per shelf, each one just a mere inch to the left/right of each other where an item could easily slide in front of the wrong price tag. It was 1 shelf, 1 type of product on the entire shelf, 1 price tag on the entire shelf = IMO they should honor the price, but they refused. Both employees working were mouth breathers who barely understood English, and I just couldn't be bothered to pursue arguing w/ their consumer relations hotline over a few bucks. But, I wonder what the law says about an item stacked in front of the wrong tag?

Here is the Legalese for Massachusetts:

Mandatory Labelling is for Grocery/Pharma Items under $20; the lowest displayed price takes precedence.

So if a bag of carrots, normally $5.99 is labelled $2.99, a store has to let it go (and then run back and fix the labels & stickers)

However, for non-Grocery Items over $20, any incorrect displayed price in excess of 20% of the typical cost of the item is considered a mistake and not actionable/enforceable under the Labeling laws.

The exception is if it is clearly and intentionally advertised in a bait-and-switch (IE come pick up your Oral-B Electric toothbrush for a Penny! Target loves you so we're practically giving it away at a Penny! Come on Down!), which this was not.

So a store is under no obligation to honor the sale of an $80 Electric Toothbrush if it is mistakenly labelled at a penny (but it might have to honor for $70 if it was displayed as being priced as such).
