First, I don't agree with the bill, but be aware this is ONLY about whether an offender appears on the sex offender registry. They are still guilty of statutory rape. Nothing has changed.

SACRAMENTO, Calif. (AP) — California Gov. Gavin Newsom on Friday signed a law that would give judges a say on whether to list someone as a sex offender for having oral or anal sex with a minor.

The bill would expand the discretion currently granted judges in statutory rape cases and was promoted as bringing fairness under the law to LGBTQ defendants.

The current law, in place for decades, permits judges to decide whether a man should be placed on California’s sex offender registry if he had voluntary intercourse with someone 14 to 17 years old and was no more than 10 years older than the person.

But that discretion only applied to a man who had vaginal intercourse. The new change permits judges to use that same discretion when the case involves voluntary oral or anal sex.

The measure won’t apply when a minor is under 14, when the age gap is larger than 10 years, or when either party says the sex wasn’t consensual.

The bill was introduced by state Sen. Scott Wiener, a San Francisco Democrat.

Did you read anything I wrote. Here, from a "pride" legal site:
In California, statutory rape involves sexual intercourse with a minor under the age of consent. Regardless of the victim’s consent, sex with a minor is always considered to be statutory rape because minors are statutorily unable to consent to sex. Unlike some states, California does not have a Romeo-and-Juliet Law, which allows sexual intercourse between two couples if they had been together and had intercourse prior to turning 18 or having a close age relation.
The rapist will go to jail.
Now, with the recent law change, the rapist will appear before a judge to determine if he will be placed on the sex offender registry once he serves his sentence. Previously, there would be NO judicial discretion and the offender would automatically be put on the list.

At 14, I was ready and eager for sex, and able to discern relationships I wanted with no desire for the partner's life to be ruined, and those that were malevolent and would need legal intervention if they came up. Some teens have this level of agency, others don't; therefore allowing a judge's discretion is legally sensible.

The new law appears to give the legal system the tools to lay off the type of cases where the couple would end up married with kids anyway, while having power to intervene with predatory types. A good balance between my hate of pedophiles and hate of zero tolerance rule systems.

I've helped raise a couple sets of older stepkids over the decades, plus a niece and nephew. I've actually put in the work of parenting the kids in my care, teaching them healthy relationship concepts and boundaries, guiding and guarding where necessary. I made a lot of open and grotesque pedophiles disappear off Yahoo360 back in the day, linked to young teen stepdaughter's account.

I see the government and legal system as a backstop, not a substitute parent or nanny, for the sexual misadventures of 14+ minors as legislated.

If you know anything about parenting you’d know that 14 yo know nothing about anything and can be easily manipulated. Which is why there is no consent before 18.

Gonna call absolute BS on this line. Yes, even 10-12 year olds get horny and start "exploring" themselves. Maybe even have sex. A 14 year old simply has no concept of the ramifications that sex can bring. A good friend of mine had a kid at 17. She admits she fucked up and would turn back the clock if she could. I get the 16 year old getting with a 18-19 year old being borderline.

But a 14 year old with a 24 year old is out of bounds. The 14 year old has ZERO clue what is happening and you did too at the time, but for some reason you support it. It's pure manipulation and slightly scary that you think it's okay and makes me question your childhood in all honesty. 14 and 24 ain't normal even if you "think" you could ruin their life. At 24 you have plenty of opportunity to fuck 18-24 year olds. There's no shortage of them.

No, the legislation is ONLY about the sex offender registry. See California bill eliminating sex offender list inequity toward LGBTQ people passes.
SB145 by state Sen. Scott Wiener, D-San Francisco, would remove automatic sex-offender registration for young adults who are convicted of having anal or oral sex with a minor, leaving the decision up to a judge.
You can also read the actual text of SB-145 Sex offenders: registration.
Like I said I'm not happy with the law, but it is only about the sex offender registry. It does not remove criminal punishment for statutory rapists.

I consider that an edge case, and I'd expect it to get exponentially harder to meet the criteria for every year of age gap over about 5 in a well functioning system.

I don't see this as a gold rush to pedophilia, but discretion to avoid punishments that don't fit the crime.
