Biden White House Defends Trump China Tariffs in Legal Showdown

The Biden administration is defending President Donald Trump’s 2018 expansion of tariffs on Chinese goods against lawsuits brought by thousands of U.S. companies, which claim Trump overstepped his authority and that his own statements and tweets undermined the official justification for the crackdown.

Attorneys for importers including Walmart, Disney, Lululemon, and Walgreens claim Trump illegally increased the number of Chinese goods subject to duties under Section 301 of the U.S. Trade Act of 1974.

But the Biden administration, in its first substantive answer to the complaints, said a president’s trade policy through the U.S. trade representative is due substantial deference.

“The Court should not interpose” because no clear legal violation occurred, the Biden administration argued in a brief filed March 12 at the U.S. Court of International Trade in New York.

While the new administration has made a clear break from Trump in most other policy areas, it won’t do so with the Chinese tariffs it inherited because they provide leverage in future negotiations with the world’s biggest U.S. trade competitor, international trade experts told Bloomberg Law.

The fricking Company I worked for had a facility in Shenzen... making it cheap and selling it like its made in the states... Every Company with overseas facilities, is at risk. The Technology is "Stolen", and reproduced in the Multi Floor buildings, where anything from Apple Peelers to Zippers are made... each floor is a business. they are allover the landscape of the city.
It's not a matter of the chineze being better, corporations taught us to turn the other cheek, and be lazy... just take bidens money and stay home...
You fall for that, and we all fall and fail... after all that's what china wants, as they walk around the world, with no cares but "being the world".

I've been warning people about this for decades. Put nearly all our eggs in one basket. What happens if we go to war? They simply stop shipping us everything that's manufactured there, and then take it all, using the factories to produce for themselves.

We gave them everything, and paid them at the same time.

Of course, because it'd be so destructive to us, our politicians can't allow war to happen, so they'll just bend over and do anything China asks instead. They hold all the cards due to short-sighted greed by corporations and political hacks. Plus the average citizen can't see past the ends of their own noses either, thinking it's all great because they get their "stuff" for rock bottom prices.

Trump initiated to have a semiconductor fab perhaps in Arizona for a strategic reasons. Give the chip shortage it's best time to start one immediately in US.

I recall in the 90s and early 2000s hearing people say "the more intertwined we become with chyna, with us depending on them, and them depending on us, the less likely a future war will be between us".

It sounded like a reasonable argument back then. But fast forward all these years, and I think we now depend on them much more than they depend on us. Fixing the trade imbalance may be in our favor, implying they get more money from us, but money is just one thing. We could stop their money flow, but they could stop all the product flow we depend on, including pharmaceuticals. We fucked up big time.

Long term, I agree. We can build stuff ourselves, or find a new country to be our slave labor.

But as long as they hold their position, they could cause one helluva crisis for us if they stopped everything. IMO a bigger crisis for us than for them. Although I'll admit I'm unfamiliar with what services we export to them, that they may depend on.

That bill, led by Sen. Tammy Baldwin (D-WI), only passed through the Commerce, Science and Transportation Committee this month but was added May 12 as an amendment to the much larger Endless Frontier Act (S. 1260), which is the darling of Sen. Chuck Schumer (D-NY), a renown China hawk.

I gotta agree with the Dems on this one. I want "Country of Origin" on all products whether sold online or on store shelves. If Chuck Schumer truly is a "China Hawk," he will has issues with China owned Biden.

True, use the automobile example. Automobiles already have labels that state place of final assembly and state percentage of locally sourced materials.
