New York City Mayor Bill De Blasio just announced that all private-sector employees have to be vaccinated against the coronavirus vaccine. This appears to be the first state or city vaccine mandate in the United States that applies to all private-sector workers. In October, Mayor De Blasio imposed a similar vaccine mandate, but it only applied to NYC’s city workers.

Mayor De Blasio’s vaccine mandate applying to all private-sector employees stands out in light of the temporary legal setbacks that many of President Biden’s coronavirus vaccine mandates have encountered. So this brings up the question of whether NYC’s private-sector employee mandate will have a better chance of surviving legal challenges.

The Legal Basis for NYC’s Private Employee Vaccine Coronavirus Requirement
The authority for a city or state vaccine mandate is based on well-established law. Specifically, it’s the Tenth Amendment to the U.S. Constitution.

In essence, this establishes that the federal government only has powers given to it by the Constitution. All other powers and rights (not otherwise forbidden to the states) shall be given to the states or the people. One of the most prominent types of power given to the states is police power.

Police powers refer to the legal right for a government to make laws that regulate the public good. The federal government will have some specific police powers (like regulating food and drugs), but general police powers belong to the states. Examples of general police powers include a town or city establishing rules about curfews, zoning laws or vaccines.

Using state police powers for vaccine mandates relies on two U.S Supreme Court cases, Jacobson v. Massachusetts (from 1905) and Zucht v. King (from 1922).

In Jacobson, the Court upheld a local law that required individuals 21 years of age and older to get the smallpox vaccine. In Zucht, the Court concluded that a school could impose vaccination requirements for its students.

Various cases since then have given states a large amount of deference in passing laws concerning public health measures, including compulsory vaccinations that provided no religious exemption.

One of the important aspects of NYC’s vaccine requirement for private employees is that it’s universally applied. This could help the law survive religious freedom challenges. When contesting a law of general applicability on religious freedom grounds the court will use a less stringent level of review.

For instance, if a state passed a law that said all practicing Catholics had to do X, Y and Z, then the courts will apply the highest level of judicial scrutiny possible. This gives the least amount of deference to the government’s reason for having that law. But if the state passed a law that applied to all citizens, regardless of their religious beliefs (a law of general applicability), then the court uses a more lenient level of judicial review that’s more deferential to the state.


Conclusion: Expect this bullshit to spread like wildfire to SF, Oakland, San Jose, LA, Seattle, Portland, Chicago, Philly, Boston, hell...lots of Bluetarded cities. At serious risk is California imposing this shit state-wide.

(This is the narrower one for city employees, not the insane new one, which has even less chance of survival.)

NEW YORK, NY—New Yorkers are having mixed feelings about the NYPD's new stop-and-forcibly-vaccinate policy. The controversial policy would be the first in the nation to allow police officers to inject the COVID-19 vaccine into any motorist or pedestrian they choose to profile based on their appearance.

“Some people say it infringes on their right to decide whether to inject a substance into their own bodies,” said NYPD’s Chief of Police while demonstrating how to retrofit syringes onto standard-issue tasers. “But then again, others believe unvaccinated New Yorkers are like leprous zombies who explode on contact. This policy is meant to reduce the number of leprous zombie explosions during Broadway shows, I guess.”

Mayor Bill De Blasio took some time away from watching a SWAT unit use a Gatling gun to pepper a passing school bus with hundreds of syringes, and explained the importance of this new policy.

“You see, the Omnomicromicon variant is the most dangerous variant in the known universe; it vaporizes its victims on contact, and spreads virally through our thoughts and feelings, according to MSNBC. The only way to stop it is through a powerful, unstoppable, totalitarian police state!”

When reminded that such a policy would end up targeting black and minority communities most, the mayor replied, “Who cares? They’ll still vote me in as governor next year!”
