No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

I have been deprived of property (shares of SBER and YNDX) without due process of law.

How do I sue the government?

But seriously folks, isn't this an overt violation of the 5th Amendment?

How does such a case proceed?
2   Shaman   2022 Aug 4, 2:58pm

When and under what circumstances did this theft occur?
3   Patrick   2022 Aug 4, 2:59pm

Schwab took the shares from me and put them in an "escrow" account because of an order from the Biden adminstration.

I don't have access to the shares and they will not tell me if I will ever get them back.

Yes, please answer @Shaman.
5   Patrick   2022 Aug 4, 4:06pm

I answered Shaman, if you were asking me to.

You can ultimately beat the rap, but not the ride.

The Founding Fathers AND the British would have been appalled.

You could face prison time or at least damages for boarding neutrals and siezing the property, even in nebulous circumstances.

Anglo-Saxons have traditionally, unlike Continentals which we are becoming, been disgusted by government seizure of property that did not arise as punishment for a crime.

I split lines on semicolon

1-No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the
land or naval forces, or in the militia, when in actual service in time of war or public danger;
2-nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb;
3-nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law;
4-nor shall private property be taken for public use, without just compensation.

Does this mean chunk #3 is all connected? Like, the "deprived of property" clause is in reference to a criminal case?
10   Patrick   2022 Aug 4, 6:51pm

I think #3 is two statements:

No person shall be compelled in any criminal case to be a witness against himself.
No person shall be deprived of life, liberty, or property, without due process of law.

You will have to get in line.

There are all the property owners that were unable to evict tenants for not paying rent during Covid. Negating several centuries of contract law.

All the small businesses that went bust because the government illegally shut down their businesses.

All the illegal vaxx mandates persecuting people.

All the lockdowns, denying public spaces to be used by the citizens, illegal mask mandates causing damages to peoples health.

Considering the government overreach that has been inflicted on pretty much everyone, you're getting off cheap.

?

What I mean is that powerful people, corporations, or the gubment can fuck with you as much as they want, and they will fuck you. You can sue them in court, they can drag it out for years, sometimes decades, in an attempt to financially bleed you dry. At the end of all this, if you've managed to hang on, you will probably win, but did that change the fact that they fucked you in the first place?

I also had to deal with the vaxx mandate terrorizing relatives, and the lockdown bullshit.

I think my cost in this is more than average when you add in the stock confiscation.

But my important point is the direct violation of the Constitution.

SBER

You could sue...it would be a class action lawsuit, so you won't have to bare the costs alone. It could be good for peace.
15   Patrick   2022 Aug 5, 8:17am

Thanks, I'll try to find lawyers at the intersection of stock class action and Constitutional law.

Yes, I see what you mean.

Still, i have to try to fight such an open violation of the Constitution. Looking for recommendations on the kind of lawyers who might handle this.

Got a reply from one law firm:

Good afternoon Patrick,

Thank you for reaching out regarding SBER and YNDX stock in your Schwab account. As you may know there have been sanctions placed on many Russian companies so trading on YNDX stock for example was halted on the NASDAQ on February 28, 2022. Because of the sanctions various trading platforms have struggled with what to do with halted shares. We are investigating the best ways to help shareholders. Currently we have a few investigations into brokerage firms.

And then they encourage me to log my stock holdings with them, but that's it. No path for getting my stock back, or the value of it.

Do you mind me asking what the value of these stocks are to you?
19   Patrick   2022 Aug 5, 8:50pm

About $30k total I think.
20   Patrick   2022 Aug 16, 8:13am

Give me my fucking stock back.

JPMorgan and BoA can trade Russian bonds, but I can't own shares of YNDX and SBER?
21   Misc   2022 Aug 16, 8:30am

File a complaint with the "Justice" department.

See "Lawsuits are the Answer".

Oh, you mean you can't file a lawsuit to make the Justice Department file charges against B of A or JP Morgan employees??????

Which government? It was by Putin's order all foreign holders of Ruscist stonks were prohibited from selling. You can sue Ruscia, I guess, but you'll be at the back of a loooooooong line behind relatives of civilians killed by indiscriminate bombings, then people who lost their homes to the same, then businesses with assets destroyed in the criminal war, etc.
