I don't know about Phoenix. Ive looked at close to a hundred homes in San Jose and some surrounding cities. Pretty much every one had missing permits. Ranging from simple stuff like windows all the way to plumbing/electrical/roofing.
In every case the listings say something like "buyer to check permits".
Seems like it should be illegal, but even if it is, it's not enforced.
Question for those in the Phoenix area - a friend turned over her house to the bank, and it recently hit the market after the bank took it back. The interesting thing is that she had an addition done to the house with no permits.
This is evidently reflected in the listing in that the square footage isn't included in the listing. Instead, a square footage "range" is given, as well as lot size "range." Let me repeat: no mention whatsoever in the public remarks that there's an "issue" with this house.
My first question: is this common practice in the Phoenix market?
My second question: the listing agent is likely aware of the situation, given the lack of square footage. Are there MLS rules about disclosure when the listing agent and/or bank is aware of unpermitted additions?
This is a 3% HomePath property, if that makes any difference.
