Here's one. While Judges everywhere uphold the powers of even the lowest levels of governance to impose mask mandates, they simultaneously shoot down the powers of the highest executive of the state from banning them - that is, reducing government oversight.

Earlier this year, DeSantis called it “completely unacceptable for either the government or the private sector to impose upon you the requirement that you show proof of vaccine to just simply be able to participate in normal society.”

The new rule comes nearly a week after a Florida judge ruled that DeSantis had overstepped his authority by banning public institutions from enacting mask mandates.

In his opinion, Judge John Cooper wrote that state law “does not support a statewide order, or any action interfering with the constitutionally provided authority of local school districts to provide for the safety and health of children, based on the unique facts on the ground in a particular county.”

He added that the governor’s order contradicts a medical and scientific consensus that masks are effective in curbing transmission of COVID.

So the fuck what? Medical and Scientific "consensus" isn't elected and has no legislative or executive power.


“The evidence submitted by the defendant [the state] I think reflects a minority, perhaps even a small minority of medical and scientific opinion,” Cooper said.

Despite the judge’s ruling, the Florida Department of Education announced earlier this week that it had withheld funding from two school districts that imposed mask mandates without a parental opt-out in violation of the mask-mandate ban.


The state said it would withhold an amount equal to the school board members’ salaries and that it plans to continue withholding the funds each month until the districts change their mask policies.

In one of the most twisted opinions I've read, Judge Royce Lamberth (Reagan)--who eagerly threw J6ers including Jake Chansley and Rachel Powell in prison for years--has halted the president's exec order denying treatment for federal inmates suffering from "gender dysphoria."

The plaintiffs in the lawsuit are "transgenders" who use new names to represent their chosen gender--but also to conceal the convictions that led to their lengthy incarceration in federal prison.

Meet the criminals Judge Lamberth claims are being denied constitutional rights and harmed by the Trump administration.

"Alishea Kingdom" according to court docs "is a transgender woman who was diagnosed with gender dysphoria in 2016, prescribed hormone therapy injections, and approved to receive social accommodations including women’s undergarments and cosmetics." After the president's order, "she" was denied those treatments and accommodations.

"Ms. Kingdom states that the discontinuation of her hormone therapy caused her to experience anxiety, hopelessness, panic attacks, and suicidal ideation," Lamberth wrote.

Except Kingdom's real name is Joshua Mueller.

In 2014, at the age of 23, Mueller was sentenced to 15 1/2 years in prison for armed robbery in Milwaukee where he shot a store employee. He is currently incarcerated at Fairton FCI.

The emergency motion for a TRO was filed today--the family is represented (for now) by a USC law professor.

The motions for a TRO and a writ of habeas corpus are under seal on PACER. As is now custom, the Trump adm was not given a chance to respond before Judge Gallagher halted the removals.

The premise is stupid: judges have very good checks on them inside the judicial branch while POTUS is unchecked by anything in the executive branch and Congress is too slow and often gridlocked. Judges acting as a quick check on the top executive is a feature, not a bug.

Nope. Every minor little district judge is ruling not as a class, but holding up particular cases without hearing the government sides.

Judiciary has 0% constitutional power over foreign relations; SCOTUS has routinely ruled that courts should stay the hell out of Foreign Policy, Nat Defense in all but the most egregious circumstances.

Not because Obama-Biden judges want wide open borders and no deportations.

The solution is to exclude immigration and nat def concerns from the lower level fed courts entirely. More on that below.

But then you get to political cases, and everything goes crazy. Take it from a lawyer – the kind of antics that go on in political cases have nothing to do with the normal law that goes on day-to-day in other courts. Procedurally, you don’t have crazy things like ex parte motions to certify a class filed at 3 a.m. on a Saturday morning and granted within 15 minutes without allowing opposition. This doesn’t happen. And substantively, you don’t have courts ruling on matters where their jurisdiction has been expressly removed by legislation or otherwise ignoring the clear text of the Constitution and the applicable statutes. In normal cases, judges hate to be reversed by the courts of appeal. In political cases, lower court judges seem to wear reversal like a medal and run hog wild.

The Lefty federal judges have been uniformly humiliated as one temporary restraining order (TRO) after another gets tossed by the SCOTUS. Judge James Boasberg of the DC District, the very model of a judicial “Resistance” activist, is about to get his ass impeached after ten-years of dabbling in malicious abuse of judicial process (28 U.S.C. § 2680-h under the Federal Tort Claims Act), plus 18 U.S.C. § 1001 (false statements or concealment in federal matters, potentially covering abusive filings), and 8 U.S.C. § 1503/1512 (obstruction of justice via tampering or corrupt persuasion, applicable to malicious process abuse), Stand by on that. Might be a caution to the rest of the federal judge gang to back off their Resistance shenanigans.

In case you haven’t followed the story — since The New York Times and network news won’t report on it — we are in the midst of the “Arctic Frost Investigation” scandal when, in 2022, “Joe Biden” induced AG Merrick Garland and FBI Director Christopher Wray to go mad-dog on Donald Trump and hundreds of political conservatives, including nine US Senators, whose phone records were seized, with gag orders (from Judge Boasberg) to prevent notification of the seize-ees, which has raised accusations of violating their First Amendment rights, and grand jury secrecy. Arctic Frost is still unspooling, with reverberations to come, including insights on the Jack Smith / Norm Eisen lawfare spree in 2023-24 against Donald Trump that followed it.

A federal judge on Wednesday said he plans to grant bond to hundreds of immigrants whose arrests during Operation Midway Blitz are being challenged under a consent decree that limits so-called warrantless arrests that occur without a prior warrant or probable cause.

In a packed hearing at Chicago’s federal courthouse, U.S. District Judge Jeffrey Cummings ordered the immediate release of 13 people whose arrests the Department of Justice agreed violated the 2022 agreement.

The judge also told lawyers for the government to produce a list by Nov. 19 detailing how many of a subset of 615 class members were still in custody, and whether they qualified for mandatory detention due to a prior criminal history or removal order.

Unless a detainee was shown to be a security risk, Cummings said he would allow their release on a $1,500 bond and some form of monitoring, including electronic ankle monitors, pending the outcome of immigration proceedings. Most of those arrested were originally processed at the U.S. Immigration and Customs Enforcement facility in west suburban Broadview, but have since been moved to jails around the country.
