Biden’s Vaccination Mandate: Where Are the Regulations?

The Human Resource order comes down to you with ferocity: get the vaccine or lose your office access and eventually your job. You are stunned. You had heard that the Biden administration was favoring this but your company has only 150 employees and it lives entirely within the private sector. Surely this cannot be right. Surely there is a way to fight back. Maybe a lawsuit against the mandate is in order.
The HR department says it is only following federal guidelines. So you look for them. You look again and again. Somehow nothing turns up. You can find plenty of statements by Biden and administration spokespeople. You can find hundreds of news stories about the impending regulation. There is no shortage of blustering talk.
What you cannot find is an executive order from the Biden administration. You can find no directive at all. How can something be challenged that doesn’t actually seem to exist?

I am not a lawyer, but this looks like wide open liability and happy hunting season for lawyers seeking damages from employers who have mandated the jab. Employers and University administrators beware. Your keester is hanging out in the wind.

Yes, we’ve heard all about Joe Biden’s alleged vaccine mandate for private companies employing 100 or more people. It was all over the news even before he announced it on September 9. His announcement has jeopardized the employment of millions of Americans and increased worker shortages in critical domains such as health care.
There’s only one problem. It’s all a mirage. Biden’s so-called vaccine mandate doesn’t exist — at least, not yet. So far, all we have is his press conference and other such made-for-media huff-puffing. No such rule even claiming to be legally binding has been issued yet.
Where Is Biden’s Vaccine Mandate?
It may prove more useful as a Sword of Damocles than a real requirement.
Regarding David Rivkin Jr. and Robert Alt’s “Biden’s Lawless Vaccine Mandate” (op-ed, Sept. 29): A more accurate headline would be “Biden’s Nonexistent Vaccine Mandate.” Surprisingly, Messrs. Rivkin and Alt often use the present tense when discussing the mandate. This could lead people to believe that a nonexistent mandate carries the full force of federal authority.
The mandate’s nonexistence shields the Biden administration from legal challenges that may ultimately restrict the Occupational Safety and Health Administration’s authority. Yet the mandate is still effective at compelling industries and companies into compliance, as it leaves room for any eventual issuance to target noncompliant entities. This implied cudgel is particularly effective on industries and companies that are dependent on federal spending or the goodwill of federal regulators. The nonexistent mandate also allows so-inclined state and local governments and companies to issue their own mandates, seemingly in lockstep with Washington.

Good to know but everyone is expected to upload their vax card to HR portal to enable badge. Remote option is not working for all unvaccinated who need to work with certain hardware stuff like me. it’s alleged this is biden “playing hardball” and setting up for huge fines on companies that fail to comply with his (almost certainly unconstitutional) announcement on sept 9 that OSHA would mandate vaccination to work at any US company with 100 or more employees.
but is he? because this looks like fraudball and intimidation to me and the reason is simple:
there is no law. there is no mandate.
