My SIL law is a functional binge drinker and pot head and literally cannot operate a car because of it. Bad decisions.
My wife and I don't have full custody or guardianship. Our situation is even more complicated because baby daddy is usually in prison. My SIL thinks she'll be able to get a license again, but there's no chance of that with 6 DUI convictions. Another felony for obstruction of justice in a murder case. She's not bad if you met her. Hot. But you can't raise a kid in todays world without a car and license and felonies.
Not sure your situation if you want to take them in or not or someone else does. First step is get a copy of the death certificate of the ex-boyfriend. I've done it here in IL for travel insurance and in Wisconsin for a random on a camper I bought for gaining title. It should be possible. The niece if drugged out might be a problem for you or anyone that wants to take in the kids.
Key is getting the kids normalized from the situation. If they're over 5, kids are not dumb. They know they live a fucked up life. Key is getting them settled in a solid family. Not sure if you were taking them in GNL.
Biggest issue is going to be if the niece wants the dependent tax break, so custody might be an issue. And she has to let go. Full custody is best, but that's usually difficult with women that are addicts. They think they can still be a mom. They're delusional.
Basically knock out everything in one fell swoop if you can catch her sober. She's not likely to let go of guardianship though. Possible but don't get your hopes up. Court order guardianship is possible, but you'd have to spend some $$$ on attorneys and court fees. If she can somehow fight it even more money.
Best bet is to say you can still see the kids, but I (or someone else) is going to take care of them. It works well enough in our situation though my SIL still gets ghetto and I have to put her in her place. Sometimes physically. Our story and my life is something strange. I actually plan to ghost write a book about it.

Well, given that it's your niece who had the kids, it sounds like you have a sibling who is the grandparent. Maybe sibling and spouse are the logical people to raise the kids.
My own niece is an alcoholic legally forbidden from driving anymore after many DUIs and accidents, and has a daughter via a black guy who is usually in jail. My sister raises the girl, her granddaughter.

My wife and I won't be taking the kids but I'm heartbroken. Life can be a real bitch for some people. I blame my sister. Broken homes are absolutely terrible. My sister and her kids know nothing other than broken marriages. My sister is adopted. She found her birth mother through 23 and me and she told her my parents stole her. Life can be so fucked up. It's a cycle that knows no end, I'm afraid. I've told my parents several times that the best thing they ever did for me is stay together and have a decent marriage.

Why am I telling this story?
My niece is a drug addict living on the streets of Baltimore. How she's still alive, I have no idea. Anyway, her ex has been raising 2 of her children (they aren't even his kids). Now those 2 children have no father or mother.
