SCOTUS has demonstrated that they are both arbitrary and asinine. When the extortive legal process is this far out of bounds, it is more commentary that the system does not serve the Republic and is broken. This is the cost and humiliation of foreign administration.

It appears the problem, according to the Lefties, is ….a lack of Due Process. Once that occurs he can be sent back. To the lawyers here, why can’t he be given Due Process in absentia???

You're not afforded due process if here illegally. He's not a citizen. Any non citizen can literally be booted at anytime. If you don't have a valid visa or green card, goodbye. Adios.

Fly private into a country like France without a passport. They'll jail you or send you back. Every country would. This isn't all that complex.

I could do the southeast, but not the northeast. That place is toxic. Any state Maryland or North is trash. Not sure how you do it zzyzzx. DC I do like for the monuments and history, but that's it. Maybe Acadia in Maine. Outside of that I have no interest in the northeast. And yes, I've been to all the states in the lower 48.

Lefty here. This is exactly the problem. No issues with illegal gang members being deported. I want that to happen, WITH due process.

The reason I care about due process is that I do not trust the executive branch (or at a more local level the police) to be accurate whether people are legal/illegal/gang members/criminals or whatever. I want a separate branch of government (the courts) to review what they are doing and double check that it correct and not being done as a tool for political repression.

If we don't hold them accountable to follow due process, how do you know whether the people they are deporting/incarcerating are actually criminals or are just people they dont like for political reasons? What about when your natural born citizen are disappeared and they say its because they were illegal so no need for due process? If there is no due process, there is no opportunity to check if they are lying/mistaken about the crimes or immigration status.

As far as "can it be done in absentia?" I dont know for sure... I'd assume there ARE ways to establish due process remotely if all parties were cooperating. But if they are deporting people to prisons outside of USA, and the prison country will not cooperate to repatriate people in the event they are requested to, then that pretty much precludes any possibility of due process.

The reason we lefties are worried here is that the administration seems to be testing the boundaries of incarcerating people without due process. This is a serious concern. I care more about due process as a core american value than I care about a random gang member in Maryland.

Again, I want gang members deported, WITH due process.
