Huh? Most recently Bob Menendez and the very Santos you mentioned were investigated and indicted while in office. I'm pretty sure a congresscreature can be investigated, indicted and convicted while still holding a seat. Expulsion is not a prereq but rather a consequence of being indicted and convicted.
