My guess is, he thought it was supposed to be an enlargement operation. He clearly didn't need a penis pump, as those are for people who do not get blood rushing to the penis. So they need an inflatable tube inserted to help.

According to one article, the doctor was willing to remove it for a huge out of pocket charge. So the guy did nothing for four months:

A woman (small business owner) I know noticed a small sore in the back of her throat - then went to the dentist to have a tooth pulled a couple of months later and he described it as a large blister. She has no insurance and few $, so she attempted to make an appointment with a free clinic. The wait is about 3-4 months.

3-4 months can be a death sentence when dealing with a fast-growing cancer, if that's what it is.

So she made an appt with an ENT. He saw her and referred her to an oncology ENT. He saw her, and ordered tests, then wants her to come back. So far she's at $5,000 and hasn't even been diagnosed... if it's cancer she will have to figure out how to pay out of pocket for chemo/radiation, or wait until the blister becomes life-threatening...

The woman is in her early 50's and one of the docs I work with suggested she get a job anywhere that has medical insurance in order to be seen sooner. Except, even if she gets a job, insurance for lower-wage jobs usually takes 90 days, effective the first of the month following the 90'th day. And if she's been treated at all before then (which she has), this will be denied as a pre-existing condition.

Fuck. This guy's dick problem is a perfect example of how we're all screwed without insurance.

Let's see if he can get the evidence to stand up in court!

The jurors are going to have to think long and hard on this one.

I don't know how things work in whatever obscure corner of Florida you live in, but I I take a car in and they spend time running diagnostics they charge. Same with electronics. Same with appliances.

Not if they don't find the problem.
To diagnose the problem and then tell you what the problem is.
Is perfectly acceptable, if you get the repair done, most shops will factor in a deduction on the diagnostics, and charge you for the repair. They charge you for the analysis in the event you chickenshit out, and grow cold feet because repair isn't worth it.

But I damn sure would not pay a Bozo one thin red cent, if he couldn't figure out why my car isn't working.

That is why most shops refuse to troubleshoot electrical shorts. Because they could spend a week on it, and still not pin point the problem.

So you're saying that, in the above case, the MD shouldn't be paid if the patient doesn't recover?

- What if the patient delays treatment or chooses not to follow MD treatment plan and dies. MD shouldn't be paid?

- What if the condition isn't treatable?

- The first doctor referred to the second doctor, as per protocol when a suspected cancer. He shouldn't get paid, when he was referring to the appropriate treating physician. He felt that he couldn't order the tests because he wasn't the treating physician.

- The second doctor couldn't order the tests before he saw the patient, because he hadn't seen her and therefore didn't know what to order. Also, she wasn't yet his patient so he couldn't order tests until he saw her.

The shock to me is that he would be having any kind of urological problem at only 44!

Check ups and routine visits aside. If I've got a blister in my throat and you wanna send me over to some million dollar laser zapper and charge me thousands for it. You better be damn sure it can do what the Doctor can't.

Jury finds no negligence in trial over man's 8-month erection

WILMINGTON, Delaware (Reuters) - A jury on Monday cleared a doctor of negligence in a lawsuit filed by a Delaware truck driver who underwent a penile implant procedure and ended up with an erection that lasted eight months.

"We're stunned," attorney Michael Heyden said as he left the New Castle County courthouse, where his client Daniel Metzgar, 44, of Newark, Delaware, was suing urologist Thomas Desperito of Wilmington, Delaware.

In April 2010, four months after the procedure was performed, Metzgar experienced swelling and went to a hospital, where he underwent testing. Before going to the hospital, Metzgar had been unable to reach Dr. Desperito.

The doctor's lawyer argued that hospital staff who performed tests were unfamiiar with penile implants and were not properly trained to do them. Therefore, the results from the tests, including images showing swelling, did not prove negligence.

Metzgar and his attorney during the one-week trial described the frequent discomfort and daily embarrassment he experienced after the procedure - including trouble riding a motorcycle, wearing normal clothes and joining family social events.

"I could hardly dance, with an erection poking my partner," Metzgar told jurors at the start of the trial. "It's not something you want to bring out at parties and show to friends."

Metzgar's stepson Alexander King, 18, described a once close relationship that grew distant after the procedure. King felt uncomfortable having friends over and noticed his stepfather stopped showing up at school and sporting events.

"I was - I'm sorry - highly embarrassed," he testified during the trial.

The device was ultimately removed in 2010 after tubing punctured Metzgar's scrotum. He received a replacement implant from another doctor.

Metzgar had no comment on the jury verdict.

The doctor's lawyer, Colleen Shields, said, "We think the jury reached the appropriate verdict."
