Think again, Officer Payne is being sued, and I would guess the injured man he wanted to illegally draw blood from has a suit from the police high-speed pursuit that casued the crash that injured him. (also a video).

The story is supposedly different, and that guy had nothing to do with the crash as he was a victim of the police chase. But none of that is confirmed and your theory could hold as well, however none of that matters. The law is clear, and without a warrant they can't draw blood from an unconscious person. If you don't like it you can try and change the law, but you cannot assault people that follow the law.

But, I stand by my indictment of MADD because most states charge refusal to submit to a test (i.e.. give consent) as a separate offense and suspend your license. A major problem for a truck driver. The Police needed blood because w hope the guy we cased to be grievously wounded is drugged or drunk and we can muddy the waters when a lawsuit names us is well established in practice, but not law. You can see that by the behavior of the cops in this video.

They are trying to cover their asses. Hoping they can find or stage any amount of alcohol in his blood so that they can defend against the inevitable lawsuit from him or his family.

Most cops are criminals. The video in the original post demonstrates this. If even one out of three cops were honest, one of those cops would have arrested the main cop, Jeff Payne, as soon as he laid hands on his victim. Instead they assaulted the person they are suppose to be protecting.

Firing is not good enough. This criminal cops need to go to prison for a long time. This is way more serious than selling meth.

If the courts don't prosecute and win the case against these criminal cops, it's inevitable that some other vigilante will start targeting random cops. So even if you don't give a shit about the victim of these cops, if you care about other cops you should want to see these criminal ones behind bars. The only way to stop vigilantes from rising up is for the courts to actually serve justice when cops commit crimes.

Cops are also lousy liars even though they get so much practice. It is because we are trained to believe them. Cops will even lie when they don't have to, to obtain a conviction. When they do, they are endangering good conviction with their lies that were never needed.
Yes I understood it was CYA, but I had not thought they might actually dirty the blood themselves. BTW, the truck driver is also a reserve police officer in Idaho.

How would anyone know the cop was in the wrong? Would you arrest a cop?

Hopefully with a minimum of ten years for the principle criminal cop and at least 12 months for all his accomplices. Plus civil judgements that garner their wages for decades.

Thanks for the info, so that is how this got by MADD. But I am also surprised the U.S. Supreme Court ruling did not include an escape clause 'to be used only when cops are covering up their f$#@ up.

If there were only a few bad apples, then the first cop would have been arrested by the other two, and baring that, the first three would have been arrested by the other cops who came on the scene later. All of those cops were bad by aiding and abetting a criminal cop.

Furthermore, since these cops committed multiple felonies including conspiracy, they still should be caged for 20 years. This is not a no harm, no foul situation.

So it turns out that the unconscious truck driver was also a part-time cop in Rigby, Idaho. Well, that explains why the Utah police are now so apologetic.

I wish the cops had taken the blood illegally and gotten the lab to say there was alcohol in it. Then they'd be caught falsifying evidence, which was the entire intent from the beginning.
