Why a Jeep owner is sued after dealership employee was killed during oil change

SOUTHFIELD, Mich. (FOX 2) - When a man took his Jeep to Rochester Hills Chrysler Jeep Dodge on March 13, 2020, it was for a routine oil change. But an employee died after another employee - who couldn't drive a stick shift - got behind the wheel to move the Jeep and hit and killed the first employee.

Two years later, an attorney for the man who died isn't suing the other worker or the dealership; he's suing the man who owned the Jeep. The man who was waiting in a lobby. The man who was just there for a routine oil change. As it turns out, this is the law and this story is about to get complicated.

The employee, Jeffrey Hawkins, was a married 42-year-old, father of four, and a lifelong mechanic. He worked at Rochester Hills Chrysler Jeep Dodge and was killed that March day by another employee who was driving the Jeep.

"He starts the engine, removes the clutch, and then a terrible thing happened - the car lunched and killed my client," said attorney David Femminineo.

The unnamed Jeep owner could be held liable for millions of dollars in damages because, under Michigan law, if someone is injured or killed and a vehicle is involved, the owner of the car is responsible.

That means if you let your friend drive your car and they hit someone or something, and that victim sues, they would be suing you and your insurance.

The lawsuit, filed by attorney Femminineo, is for $15 million. The insurance company of the Jeep owner has already paid out $100,000. If everything stands as it is now, with indemnity in place and the jury awards the family the full sum, the dealership would be responsible for the remaining $14.9 million.

Isn't that good news for those with teenage drivers who just might happen to let one of their friends "borrow" the car they are using despite it being in your name. Kids do the darndest things and you can end up with the darndest lawsuits.


I'm adding this to my long list of reasons not to have kids.

If you advised the insurer of the animal residing at your premises - they may or may not have advised you they will not cover damages from said animal.


Either that, or they jack your rates. Seems to me that the type of person that is going to have a dangerous breed dog is probably someone with no assets.

The driver of the Jeep could sue the dealer for even more money than the guy's family is trying to get.
Sue them for letting an incompetent driver drive his Jeep.
Fuck up's like that, are usually part of a pattern. I bet they could find them if they dug deep enough on the guy that ran him over.

Most insurers will just make note of the animal and will advise the client they will not cover any damages/claims resulting from action of the animal.


I actually had a visit from the ins co for the sole purpose of taking a look at my dog.

Here is another surprise for those that did not know this. Your car insurance carrier may not cover this as well so you are on the hook solo.

On a side note if you are one of the dog owners of the 15 or so breeds considered high risk/dangerous and you did not inform the insurance company that the animal is in the household - then the dog does something - you may / probably will be dealing with the financial end o...

Lawyers are scum and people who ruin innocent peoples lives with lawsuits are WORSE scum. Just because you CAN doesn’t mean you should. This is why things like the mafia and hired killers exist. People that file these lawsuits have no morals and should be very scared to do so.

You would be shocked/stunned to know the actual number of homeowners in very nice neighborhoods with plenty of assets and very little common sense who have these breeds and have not informed their insurer.


My brother-in-law breeds American Pit Bulls, some of the sweetest dogs I've ever met. The mother is aggressive, but he doesn't walk them, which can cause problems with any dog, any breed. Dogs are what you train them to be. People who want to blame a certain breed I've noticed don't have very much knowledge about dogs, and tend to have other issues with personal responsibility, i.e. looking for something else to blame.

The first problem is he took it to a dealership. Unless you use a coupon, you're paying out the ass for routine service. Better to use a quick lube place, or your regular mechanic.
