Trump's lawyers challenged this in their presidential immunity appeal. And since ruling on the actual immunity issue is a total shitshow for SCOTUS no matter how they rule, throwing Smith's case out because of this technicality instead must look pretty inviting to the court right now. It's their out.
Of course, the Left will have an ANTIFA type riot over the ruling.
Of course, there could be one or more other cases they are worried about. But for now I put my money on this one being the nuke going off.
Chevron is very important as it requires courts to defer to the Administrative's State interpretations of Statutes in all disputes, even if the Statutes are ambiguous and seem to exceed Congressional mandates. This wouldn't be a death blow, but it would be a haymaker to the Bureaucracy.
The current case is the National Marine Fisheries requiring commercial fishermen to pay all costs for observers for environmental and usage monitoring of the herring catch.
