It wouldn't be that difficult to set up a lawsuit over this issue if something doesn't change: if requested, just give them the password to a profile you create, and in this profile claim to be a member of as many Title VII protected catagories (wheather true or not) that you can get away with. When you do not get hired, sue them for discrimination & Civil Rights Violations. It would be the same as requesting/disclosing such information on the application or in the interview process, clear grounds for a lawsuit...

I'm also left wondering what this means for those who never had a social media/Facebook page as regards getting hired...

Well to 'set them up' you had better be fully qualified for the job and the guy they actually hired would have to be LESS qualified than you?
Hard to do unless you did something like eat a massive amount of garlic or act really weird in the interview (like Borat or something...hahahaha)

Actually you are quite WRONG - "qualifications" would mean SHIT in light of questions/requests that are in violation of your Title VII protected Civil Rights. I am quite sure - and smug - about this since I have consulted a legal expert. If any potential employer requires me to have a stupid facebook/farcebook page and give them access just to be considered for employment - I will gladly be the test case for this issue and "set them up" as I have described above - joyfully and gleefully. They would deserve every ounce of punitive punishment for their actions. A bit litigious perhaps? Absolutely yes and proudly so - I am right, they are wrong, and I would win...
