How much do you think the lawsuit will be worth?
In order for the thief to even launch a lawsuit, he has to admit to committing a crime and then he'll go to jail. It's unlikely that he'd consider that a good trade-off.
Even if he does sue, he'd have to convince a jury that would hate him for being a thief that he should profit from the negative consequences of his crime. No jury is going to award him compensation even if they think he has just cause because the jury will hate him and sympathize with and identify with the home owner.

I really think it depends on the damages he claims. I'm not going to list the frivolous claims he could make, but I'd bet they would easily outweigh the charges against him.
Was the shitbomb intentional? Yes.
Was it just? Yes, but does that even matter?
Did it cause damage? Yes again.
This guy whether he realizes it or not, has opened himself up to litigation.
