A woke DA could charge the shop owner with "artificial imprisonment."
Police say Aguirre and his date had parked their vehicles near the downtown restaurant when Nix approached them, saying it would cost $20 each to park their cars, according to a probable cause affidavit.
Aguirre paid the $40 but was later told by a restaurant employee that Nix didn?t work for the parking lot and had scammed them, police said.
An employee at a nearby smoke shop later told police he saw Aguirre run back to his car, grab a pistol and go after Nix. The employee said both men went out of his view but he heard a gunshot before 8 p.m., then saw Aguirre ?nonchalantly walking back to his car with the gun in his hand? before putting the gun back in his car. Aguirre then walked back to the restaurant and went inside with his date, according to the affidavit.

Aguirre and his date each parked their car in a lot when a man came up and asked them for $20 each to park there. Aguirre paid the man $40, paying for the lady's car like a gentleman, and then they both went into the restaurant.
While they were eating, they found out from the restaurant staff that the man who took their money wasn't a parking attendant and that they had been scammed.
According to police, Aguirre got up, left his date at the table, and went and got his gun out of his car and tracked down and shot the man who stole his money.
After he came back to the table, he assured his date everything was okay, but then he decided he wanted to leave the restaurant and eat somewhere else.
She had no idea what happened until she saw her own photo on a Crime Stoppers show the next day. She then called the police and gave the information they needed to nab Aguirre.
An Albuquerque store owner is claiming self-defense after he shot and killed a would-be burglar who allegedly dug a tunnel through the wall of his business over the weekend.
The owner, who was not identified, told KOB 4 News that he was sleeping in his smoke shop in the International District Saturday when he was awoken at about 3 a.m. by a scratching sound in the wall.
One hour later, a man wielding a large hammer and what looked like an ax burst through the wall.
The shop owner claims he grabbed his gun and told the man to get out, only for the intruder to come toward him. The businessman said he then opened fire and called the police.
The trespasser was dead by the time first responders arrived, authorities said. Police are now investigating the incident as a justifiable homicide.
