No, I’m more sure than ever now. There was a “Public Health Emergency” originally declared in 2020 by the HHS director. Its scope is limited to relaxing regulations on medical products (see Emergency Use Authorization, which depends on this declaration being in effect) and allowing unchecked funding of their distribution (“free vaccines and tests for all”). That’s it. It doesn’t abrogate any of the people’s rights guaranteed by the constitution, and doesn’t let the President spend money on anything he wants.

Yes a lot of programs cite the emergency as an excuse but these are more pork barrel than power grab. I don’t think there’s anything unconstitutional in there.

I really think the plan was to end the emergency sooner but the problem was the FDA wouldn’t approve the boosters, or any shots for children under 12. They’re still all under EUA only. So the planners can’t end the emergency until these doses are approved, because they can’t be mass-distributed without either an emergency (EUA) or FDA approval and license.

The Title 42 deportations to Mexico were only allowed because of the "Emergency".

The data reveals that cardiac-related presentations for 15 to 44 year-olds remained steady at 1,100 per month from January 2018, but drastically spiked in July 2021 through November 2021, peaking at 2,172 per month, just as these injections were rolled out, they almost doubled.

Then there was another spike in February this year, right around the time when the boosters were being mandated.

These injections are harming and in many instances killing our young people. So what does SA Health have to say about this? Nothing. They continue to roll out the injections. They continue to push the injection narrative.

I always thought that since the EUA declaration depends on the existence of a public health emergency, once that emergency is declared over, all products authorized under EUA but not FDA approved (like COVID-19 booster shots or shots for those under 12) would have to be withdrawn.

But apparently the Emergency Use Authorization declaration has a life of its own and does not automatically die with the emergency that justified it.

In other words, the end of the public health emergency on May 11 does not mean that the end of availability of the“emergency use only” medical products.

Today, the FDA issued a notice addressing the agency’s COVID-19-related guidance documents, including which of those guidance documents will no longer be in effect after the expiration of the COVID-19 public health emergency (PHE) declared under the Public Health Service (PHS) Act, and which of those guidance documents the FDA is revising to temporarily continue in effect. ...

Importantly, the ending of the PHE declared under the PHS Act will not impact the FDA’s ability to authorize devices (including tests), treatments or vaccines for emergency use. Existing emergency use authorizations (EUAs) for products will remain in effect and the agency may continue to issue new EUAs going forward when criteria for issuance are met.

Governor Grisham said she “will either amend or remove or adjust” the order after the 30-day ban period, depending on “circumstances.” Circumstances like how her emotions are feeling that day. “I realize, it is a pinch, and then some, on responsible gun owners,” Governor Grisham explained. “It’s a sacrifice that allows everyone else to get their arms around the growing, significant problem.”

Got that? A “sacrifice.” By responsible gun owners. For the greater good.

During the press conference, Governor Grisham explained she doesn’t think that constitutional rights are absolute, especially in emergencies. And she can make an emergency whenever she wants! All social problems are potentially emergencies! It’s great! ...

New Mexico Republicans were not amused. Many called her a “dictator” and other words that I can’t reproduce in this family blog. Senate Minority Leader Greg Baca (R-Belen) slammed Lujan Grisham’s order as “unconstitutional” in a statement from Senate Republicans, saying her “soft-on-crime approach has failed and put the safety of all New Mexicans in great jeopardy.”

Representative Baca has a point. The Governor just disarmed all the people who follow the law, and as she said, criminals don’t follow laws anyway. Maybe the hoodlums will go along with it since it’s a public health order.

This is just more rotten pandemic fruit. Governors who want to do unconstitutional things now think all they need to do is declare a public health emergency. It worked for covid, after all.

As I’ve said many times before, emergency executive authority is the worst, most anti-democratic idea ever, and we need to drown it in weed-killer everywhere it has sprouted up.
