But under the FISA surveillance laws, Americans' Names are supposed to be masked, and nobody has the right to communicate the names of Americans caught under the surveillance.

On January 12th, Obama took the initial masking from the NSA BEFORE they shared the intercepts, and allowed 16 other agencies to receive intel with unmasked names.

In other words, the NSA used to block out "inadvertent" names of Americans picked up in Foreign Surveillance and THEN shared it out. After Obama's Jan 12 EO, they were sharing the surveillance BEFORE the names were blocked out.

This may be why the NSA is probably going to cooperate with Nunes - to show that it wasn't their fault, the leak was somewhere else.
