The Constitution provides that “No person except a natural born Citizen . . . shall be eligible to the Office of President.” The concept of “natural born” comes from common law, and it is that law the Supreme Court has said we must turn to for the concept’s definition. On this subject, common law is clear and unambiguous. The 18th-century English jurist William Blackstone, the preeminent authority on it, declared natural-born citizens are “such as are born within the dominions of the crown of England,” while aliens are “such as are born out of it.” The key to this division is the assumption of allegiance to one’s country of birth. The Americans who drafted the Constitution adopted this principle for the United States. James Madison, known as the “father of the Constitution,” stated, “It is an established maxim that birth is a criterion of allegiance. . . . [And] place is the most certain criterion; it is what applies in the United States.”

I'm surprised at the Obama birthers, back tracking on the Cruz birther. Nothing worse than mealy mouthed dirt bags that can't stick with their convictions.
If this was Trump I would still say "No Sale". America should never elect another foreign invader ever again.

Whether the constitutional meddlers claim it's kosher depending on whether they like the guy or not. It's just good policy for the individual voter, to demand candidates who cried their first breath of air on American soil, born to two American parents. Period. I don't care what the universities say or the latest Twitter campaign or the latest rash of Social Justice warriors. No Tickey! No Laundry!

I don't think he is-but I am not a constitutional scholar. he was born in Canada and had Canadian dual citizenship till a few years ago.

Good question. McCain and Obama's birth were on US Territory (I believe the Canal Zone was technically US Territory). However, Alberta has never been US Territory.

With Obama, some people didn't believe he was born in Hawaii. If he was born in Hawaii, he's a natural born citizen. If not, he's not.

With Cruz, nobody questions his birthplace--it was clearly Canada. The question is can you be born in another country and be a natural born US citizen.

Yup and what about adopted children. What if someone adopts a jihadi-is the jihadi now a natural born citizen because their parents are US citizens?

It is the same question. I don't think anyone denied that Obama was born to an American mother, and therefore inherited citizenship.
If people didn't believe Obama was natural born because they didn't believe he was born in Hawaii, they should consequently not believe Cruz is natural born.

It's worse than that, because as far as we know, OBama was born in Hawaii. There is no evidence that contradicts this. Just rumors that get all the racists and right wing dimbulbs excited.

So you've got people that would go along with a fiction that Obama was not born in Hawaii as a pretext for calling his Presidency illegitimate, while being willing to condone a President that we know with certainty was not born in the U.S., because they like him.

Not to change the subject, but isn't there something about Cruz that makes it seem like he's gay ? Not that there's anything wrong with that.

It might have to go to court, but I think the law and precedent is for Cruz being eligible.

That said, I hope the lying pandering son of a bitch never gets anywhere near being elected to POTUS. I want about anyone but him. I think I hate Hillary almost as much.

To me, he seems like the Lawyer that Boss Hog would have called when the Feds finally nabbed him on the Dukes of Hazzards show.
If you are familar with the weekly reoccuring theme, every episode, the FEDs were investigating Boss Hog for corruption, while he was getting his lacky Sherrif department to find ways to pin it all on the Duke boys.

After reading Herc's post and re-reading yours, I think I spoke too soon. If one says Obama is ineligible due to being born in Kenya, to be consistent he should also disqualify Cruz for being born in Canada.

The several potential meanings of Natural Born:

Born to at least one US Parent, with no conflicting citizenship, regardless of where.
Born in Sovereign US Territory (using the oldest definition in the Common Law). Variant: And to at least one US Parent
Born to US Parent(s), regardless of conflicting citizenship, regardless of where.

Cruz can only be Pres if the last one is correct; he received Canadian citizenship at birth AND did not relinquish it until just recently.
