Hopium 8/30: Oberlin pays Gibson's Bakery

The shoplifting and subsequent protest of Gibson’s bakery happened way back in 2016. It took years for the Gibson’s defamation case to make its way through the courts but finally in 2019 they won a massive award. The award (initially $44 million later reduced to $25 million) was appealed by Oberlin and in April of this year the school lost that appeal. By that point the full judgment plus the cost of attorneys fees had risen to $31 million.

But Oberlin appealed the case to the Ohio Supreme Court and also asked that it not be forced to pay the Gibson’s Bakery until that appeal was resolved. The Ohio Supreme Court agreed to the latter request earlier this month. However, today it looks like this case might finally be over. The Ohio Supreme Court has refused to consider Oberlin’s appeal.

The Ohio Supreme Court on Tuesday said it would not take up an appeal of a $25 million judgment against Oberlin College in a business’ lawsuit claiming it was libeled by the school after a shoplifting incident involving three Black students…

Oberlin College in a statement said officials are disappointed the Supreme Court did not hear the school’s appeal.

“The issues raised by this case have been challenging, not only for the parties involved, but for the entire Oberlin community,” the statement said.

The issues in this case have not been challenging. They have been clear cut from the beginning and despite that, Oberlin has dragged this process out for years. This has gone on so long that two members of the Gibson family have died waiting for this judgment to be paid out: “David Gibson died in November 2019 at age 65. Allyn Gibson died in February. He was 93.” So it’s hard to have sympathy for Oberlin at this point. In my view, the school lied about its involvement in the protests and then came up with dubious legal claims to try to paying for its involvement.

Legal Insurrection, which has had the best coverage of this story for years, got a statement from the Gibson family. It reads in part:

“The jury recognized Oberlin College’s bullying tactics. The students admitted their misconduct, but Oberlin College could never admit that they were wrong. They presumed that they could bring the Gibsons to their knees. The power of truth has enabled the Gibson family to survive Oberlin’s onslaught.”

Legal Insurrection founder William Jacobson notes that while it’s not impossible for Oberlin to appeal this loss to the Supreme Court it’s extremely unlikely SCOTUS would take up a case which the Ohio Supreme Court decline to review. So this is almost certainly over except for the crying in the Oberlin administration building.

The moral of the story here is that falsely accusing someone of (or some institution) of racism can still cost you dearly even if you’re a very woke college used to stuffing the curriculum with such material. Hopefully other colleges are getting the message.

And the money part is pretty much over: In order to appeal, Oberlin was required to deposit a large chunk of the award in Escrow. Now they've lost that appeal, and will have to pay, even if they somehow try to get SCOTUS to take up the case the Ohio Supremes declined to hear at all (highly unlikely in all but the most contentious cases, which this one is not being an unremarkable Libel suit with no Constitutional or Grey-area legal distinctions in play. And all but certainly not with this SCOTUS).

Please update us if the heirs to the ruined and now deceased owners actually get the money.

I hope Oberlin is bankrupted by this. They thoroughly deserve it.

Maybe lawsuits really are the answer.

Nice, but it seems that the KommieKuts and progressives are so intoxicated with ersatz power, convinced by the briberies, temptations and promises of the Globalists. that they are impervious to any forward looking vision of ethics or consequences. This absolute shuttering of forebrain related calculus is one of the amazing things about the phenom.

The wikipedia page is pretty amazing (whodathunkit?) I'd forgotten the shoplifting incident took place the day after the 2016 election. It was a precursor to what TDS would look like as it enveloped the country.
Local police records showed no previous accusations of racial profiling by Gibson's Bakery.[4] Of the forty adults arrested for shoplifting from the bakery in a five-year period, only six were black.[18] As a part of the three students' guilty plea in August 2017, each read a statement saying, "I believe the employees of Gibson’s actions were not racially motivated. They were merely trying to prevent an underage sale." Reporters obtained an email written by Emily Crawford, an employee for the school's communications department, telling her bosses that she found the protests "very disturbing," saying, "I have talked to 15 townie friends who are [persons of color] and they're disgusted and embarrassed by the protest. In their view, the kid was breaking the law, period... To them this is not a race issue at all."[6] During the trial, Eddie Holoway, a black man who worked his way through technical college while working at Gibson’s Bakery, testified that the racist allegations against his former employer were untrue. "In my life, I have been a marginalized person, so I know what it feels like to be called something that you know you’re not. I could feel his pain. I knew where he was coming from."[6] Clarence 'Trey' James, a black man employed at Gibson's since 2013, testified that he had observed no racist treatment of customers or employees. "Never, not even a hint. Zero reason to believe, zero evidence of that."[19] Trey also told the student-run Oberlin Review, "When you steal from the store, it doesn't matter what color you are. You can be purple, blue, green; if you steal, you get caught, you get arrested."[14]

Ohio’s “woke” Oberlin College has fired its so-called “professor of peace” after allegations of brutal crimes have emerged.

Former Iran regime official Mohammad Jafar Mahallati was removed from his position as the prestigious school’s religion professor over allegations of war crimes, anti-Semitism, genocidal rhetoric, and sexual misconduct.

Mahallati was ousted following a three-year pressure campaign from Iranian Americans who were appalled that he was employed in a teaching post at the college.

The group accuses Mahallati of helping to cover up the mass murder of at least 5,000 Iranian political prisoners in 1988.
