Pure Hopium? I wouldn't bet that SCOTUS does anything courageous. SCOTUS would have to be surrounded by bodyguards and troops, in an 'airplane proof' bunker if they accepted this case. Unless, of course, something big is actually pending, which it never seems to be.

I dunno, it actually is on the SCOTUS docket to be heard 1/6/2023:

Discussion in the woosphere about why this case is being heard. TLDR: This is either a shot across the bow of Congress (who are threatening to pack the court or remove lifetime tenure because of the Roe v. Wade decision) or a setup for a Mexican standoff between SCOTUS and Congress.
