Isn't what you wrote part of the 1st sentence? The second sentence is Article 1, "All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives." In that case, the mem makes perfect sense as the ATF has no right to make binding regulations.
