That is legally false.

First of all, the Supreme Court has long and repeatedly held that speech intended to incite violence is not protected by the First Amendment. There are boundaries, of course; to be considered “inciteful,” the speech must meet certain conditions and not simply reflect some general sentiment. “Let’s fight back!”, for example, is not inciteful speech.

But that’s not what we’re looking at here, is it?

Second, and maybe more important, employees generally do not enjoy any First Amendment protection, even for their private words posted to social media. Private employers aren’t constrained by the First Amendment. Only the government is.

In early 2021, I consulted with many employees who’d been fired for posting things on social media questioning the legitimacy of the 2020 election. In one case, a woman who’d worked at a commercial real estate broker’s office for 22 years was fired after posting a meme on her private Facebook page amusingly captioned, “Joe and the Hoe.”

I had to sadly inform her that, since she was an “at will” employee, there was nothing that could legally be done about it. ...

And the Governor of Utah saying right away Tyler Robinson's roommate showed the police the messages from Robinson about a hidden gun. Robinson was that careful and meticulous like was seen on the roof 2 weeks prior.

So I can't believe Robinson was that nutty to send his roommate a message like that if the roommate had no clue what he was talking about.

And now there is a news article that the police are saying his roommate is "cooperating with the investigation", as if he was part of some AntiFa terror cell (that used Discord) to communicate and plan this Kirk assassination.

CNN, MSNBC, etc came out so quick to get ahead with their narrative of the shooter Tyler Robinson being essentially a typical young white adult from a Republican background who followed Nick Fuentes but hated Charlie Kirk because he spewed hate.

what gets me is Tyler Robinson was in a very deliberate and focused state of mind going back to walking the roof of that building two weeks before the shooting and was very careful to evade capture (until his father turned him in)

and with that being said, why send messages about hiding a gun and about bullets to his roommate if his roommate had no idea that Robinson intended to shoot Kirk ?
