Sure it was illegal! The defectionists were lawbreakers and the fact that they defeated the royal army has absolutely no bearing on the legality of their claim!

That all government is backed solely by the threat of force and violence. By demonstrating greater force than their British overlords, rightful as they may have been, the American rebels claimed their freedom by the very source of all power: violence.
Anything else is sophistry and lawyer lies.
