‘I Had to Stand up and Try to Do Something:’ Professor of Medicine on Suing School Over Vaccine Mandate

Dr. Aaron Kheriaty reacted to the COVID-19 pandemic like many other medical experts. He worked long hours as the United States tried to grapple with the new disease. He had too many conversations with family members whose loved ones were dying from it.

But as time wore on, he started noticing a pattern in public health decisions that seemed to diverge from traditional medical ethics, including an insistence that people at little risk from COVID-19 get a vaccine.

Kheriaty is now on suspension from the University of California, Irvine, (UCI) and challenging the school’s COVID-19 vaccine mandate in court.

“I had to stand up and try to do something about it,” the professor of psychiatry and director of the UCI Health’s Medical Ethics Program said on The Epoch Times’ “American Thought Leaders.”

"I knew that I would wake up in the morning & not have a clear conscience."

UCI spokespeople declined to comment for this story.

‘Liberating’

Kheriaty contracted COVID-19, the disease caused by the CCP (Chinese Communist Party) virus, in mid-2020. His infection was confirmed by two different tests from two independent labs. His five children and wife also contracted the disease. They all recovered, with none requiring hospital care.

“It was, for me, actually a very liberating experience afterward, because I didn’t have to worry about the illness anymore. I knew the science on natural immunity,” Kheriaty said.

Natural immunity refers to when people contract COVID-19 and recover. Dozens of studies have documented that these individuals enjoy strong immunity against CCP virus re-infection. Some of the studies suggest the immunity is superior to that provided by COVID-19 vaccines, particularly the Johnson & Johnson one.

“I knew that at that point, I was among the safest people to be around, I didn’t have to worry about transmitting the infection to my patients,” Kheriaty said.

He continued taking precautions, wearing personal protective equipment like masks as required at the hospital. But he was confident he didn’t pose a risk to others, which served as a relief.

That relief turned into disbelief when, around a year later, the University of California system, which includes UCI, imposed a COVID-19 vaccine mandate.

Opt-Out is Temporary

The mandate (pdf) included a natural immunity opt-out, but only temporarily. People who recovered from COVID-19 were told they would only be exempt from the mandate for up to 90 days after their diagnosis.

University officials cited the Food and Drug Administration (FDA), which alleges that the antibody tests it has authorized “are not validated to evaluate specific immunity or protection from SARS-CoV-2 infection.”

SARS-CoV-2 is another name for the CCP virus.

“For this reason, individuals who have been diagnosed with COVID-19 or had an antibody test are not permanently exempt from vaccination,” officials said.

The mandate violated rights outlined in the U.S. Constitution’s Fourteenth Amendment, including equal protection and substantive due process, Kheriaty’s lawsuit asserts.

“Plaintiff is naturally immune to SARS-CoV-2. Therefore, plaintiff is at least as equally situated as those who are fully vaccinated with a COVID-19 vaccine, yet defendants deny plaintiff equal treatment and seek to burden Plaintiff with an unnecessary violation of bodily integrity to which plaintiff does not consent in order to be allowed to continue to work at UCI,” it states.

The situation creates two classes, vaccinated and unvaccinated, when a more reasonable division would be those who are immune and those who are not, Kheriaty believes.

“What kind of discriminatory policies do we have in place that are excluding someone like me from the workplace when I’m 99.8 percent protected against reinfection whereas someone who got the Johnson & Johnson vaccine, by the company’s own data that they submitted to the FDA, is 67 percent protective against COVID infection?” he said.

Whose Burden?

Kheriaty initially planned to get a COVID-19 vaccine. Now he’s working to change the narrative around mandates. ...

Most mandates across the country don’t have alternatives for people who had COVID-19 and recovered.

Kheriaty proposes putting the burden of proof on people who want to opt out.

“Just have them go get the testing on their own time. You don’t have to administer the T-cell test or the antibody test. You don’t have to go dig up their old medical record establishing that they’ve already had COVID,” he said.

“Just ask them to bring that in and sign off on that as a kind of immunity passport.”

Side Effects ...

Kheriaty worries about other research that seems to show vaccine recipients with natural immunity experience side effects at a higher frequency than those who are not immune who get a shot.

“There are now about five independent studies that strongly suggest that individuals that already have natural immunity, when you vaccinate them, the risk of vaccine adverse events or vaccine side effects is higher for that group,” the professor said. “They have higher risk of side effects from the vaccine. It’s not going to help the people around them because natural immunity already is sterilizing, [yet] we don’t yet have any COVID vaccines that offer sterilizing immunity.”

Now this is disgusting. The doctor is now claiming good natured ignorance for his wrong-headed policies when covid came out?

A competent doctor would know right at the start:

The SARs bug resembles the cold bug more than a flu bug, and immunization against such a bug is virtually impossible.
A virus spread by aerosol will not be hindered by a mask
When doc above saw all those "body bags," he should have noticed the average age was 80+
Using 40 cycles on a polymerase type test will guarantee many false positives
SARs type bugs have a history of being treated successfully with HCQ and Ivermectin
This "epidemic" was no worse that the seasonal flu - it in no way warranted the use of untested mRNA jabs

Now that the truth is coming out, these assholes are claiming they were fooled, rather that the reality that they chose job security over patient health

I do take some issue with this.

Nazi Germany did a lot of evil things, but concentration camps weren't simply killing machines. If the purpose of a concentration camp was to simply kill victims, they wouldn't build the infrastructure for people to live at them.

If I was a sociopath, and thankfully I'm not, and I intended to kill people who were forcibly placed on trains, I would kill them on the trains. Passing the exhaust of the trains through the railway cars would ensure that, and do it cheaply. There would be no need of Zyklon B and other agents.

Concentration camps appeared to be forced labor camps, not death camps. People who couldn't work I wouldn't be the least bit surprised were killed. I'm certain they were.

After WWII millions of Germans were purposely starved to death (we are told) under the command of Eisenhower. IF this is true, this is because they believed the propaganda, and many of us do to this day. Every war starts with a lie and continues with lies compounded upon them. Don't be so certain we know what happened in WWII, perhaps we are told the truth, but it appears the starving people that were discovered, were starving because they were doing forced labor, making weaponry, and that their supply lines were cut for the war effort by the Allies.

The Allies made those starving people, not the Nazis. But also, those same Nazis turned people ineffective at work into corpses as well.

There's no good side in a war unless it's purely a defensive war, and I don't think defensive wars really exist provided the defense survives. We're a brutal species and our humanity can be stripped from any of us given enough horror and/or desperation. The Donner party is said they turned on their children for food. That could probably happen to any of us. Imagine being so desperate, you'd be willing to kill your child to survive. That's our ugly nature, and we see this in nature commonly. We're still beasts.

Our humanity, is merely a luxury in easy times and we are in very easy times, most of us are anyhow.

It was probably more from death due to overwork/starvation, and outright killing (POWs they couldn't move for logistics purposes, nor manpower to guard, especially during Barbarossa, as well as Civilians both as reprisals and by official policy).

Under radio silence, they didn't get the notice to delay the attack and were swept up by Polish paramilitary patrols miles inside Poland (over the old Czech, not current German, border). We also know they slaughtered at least several thousand people after the invasion of Poland. If they're willing to execute Priests, ex-Mayors, retired military, etc. in the thousands...

What you said is beyond my knowledge to be honest.

War is a very terrible thing. I know that without doubt.

What I don't know is what WWII was about. It's been claimed it was about overthrowing the European banking structure for example, and at the same time about the elimination of the Jews. I suspect both these are at least partially wrong.

I had an great uncle whose job it was to photograph the aftermath of the atomic bombs in Hiroshima and Nagasaki. I don't know which because we were very strictly instructed not to ask him about the war. I knew other veterans, one man was charged to recover to corpses of Normandy, he was a bitter and hateful man. He was recovering the bodies of 18 and up men. I've never seen war myself but I've seen what it has done to people who went through it - it destroyed them.

I feel very badly for Ukraine, and Russia - and I hate my nation's rulers for bringing this on. It could have been avoided. I hope there is a hell, Zelenskyy deserves it. Our rulers deserve it as well. This could have all been avoided.

When you stare at the abyss, the abyss stares back... like Saruman studied the arts of the enemy... Hitler was supposed to be a tool to crush the Reds and Unions, but then took total power, got rid of the Monarchy entirely (defying his dying promise to Hindenberg which he immediately broke), got rid of the right wing competition (Schleicher, Papen) and by the time his IG Farben and Tyssen-Krupps (Yes, the Elevator company) woke up, he had total control both within the party and Germany itself. He then pursued particularist aims of his own.

I don't know the fix either, some days I feel things are turning for the better on a subtle, fundamental level. Some days I feel like it's going to get worse and the word "Mattresses" comes to mind.

For the following reasons, the medical establishment is unequivocally untrustworthy regarding the vaccines:
The mother of all biases: The medical community bet every ounce of credibility and authority they had on the vaccines being safe and effective, so they cannot afford to ever admit they were wrong should the vaccines ultimately turn out to have real safety issues

The politicization of the medical community

The insistence on a “One Size Fits All” contrary to fundamental medical practice

The lack of consistent evidentiary standards

Few medical professionals including those involved in making policy or opining on the vaccines have any idea how the vaccines work

They got pretty much everything about covid wrong before the vaccines

The failure to treat covid

The lack of critical or independent thinking by anyone in the mainstream medical community

The medical community failed to convey basic risk stratification

Public health officials used wrong information and spurious data to construct pandemic policies

The medical community never admitted that they made serious mistakes

The denial of natural immunity

Censorship and Fraud

They don’t denounce useless and harmful practices derived from their policies and statements

The medical establishment is riddled with massive financial conflicts of interest

Every specific claim made regarding the vaccines so far has ultimately proven to be false

A significant % of the medical community are genuinely evil people

I just got off the phone with a pro-vaxxer and now, even he's surprised that Quercetin Phytosome works.

Yes, I'd sent him all my PubMed links, however, he was always convinced that it was merely for the "seasonal allergy" ppl until his family member, who caught Covid, was fine within a couple of days by taking the allergy pill, Quercetin Phytosome, since his re-ordering for the spring time, just arrived before he got sick.

Seriously, it's like people are waiting for someone on Mt Olympus to tell 'em what to do instead of taking initiative on the problem.

Anyways, despite him believing that mRNA vaccines do not 'confuse' the immune system (into an autoimmune dystopia), since his knowledge of general biology is piss-poor, he is aware that certain supplements can have medicinal effects.

So he's not a total moron.

This is more a request for information than a story.

Lately I have received several emails like this:

I am a retired anesthesiologist in XXX. Recently I had a pizza party with other doctors who are retired, or about to retire. An oncologist among us told the story of a multiple myeloma patient in his practice who after the vaccine appeared to convert to acute leukemia. He had never seen this before. He contacted an oncologist at XXX, a major referral hospital here in XXX, to ask what he thought of this. The XXX doc said he too had never seen this before, and in his practice had three multiple myeloma patients who also converted similarly. Thought this might be a useful avenue for you to pursue…

And this:

We have a friend-of-a-friend back home (in XXX) that is a cardiologist… [she] isn’t recommending any shots, which is a dramatic about-face from where she had been. She actually was canceling playdates for her young children in March 2021 if the friends’ parents weren’t vaccinated (this was the impetus for us knowing any of this, because our mutual friend was not, and had no intention of getting, vaccinated).

This was a heartache for me, so I followed up several weeks later to ask about how that schism was affecting her daughter, the shunned playmate. Well, it was all resolved. The cardiologist mother had seen the new patients she was getting after the shots and was no longer pushing them for anyone. I don’t know if she’s gone so far as to discourage patients (as opposed to close personal contacts) from getting them, but she’s not pushing them.

On two recent trips to the pediatrician’s office in XXX… I found it interesting that the pediatrician didn’t even mention Covid or the vaccine. My daughter is headed off to college in August.



Obviously, this change - to the extent it is happening - has not reached the medical specialty boards, much less the American Medical Association, which continues to push mRNA shots. But I wonder how many physicians are now no longer encouraging - or even actively discouraging - patients from getting booster shots. Taking a public anti-vaccine stance is risky for physicians. Even filing a VAERS (vaccine adverse events report) submission comes with headaches.

I wish there were more doctors with integrity. Right now, I have zero faith in the medical profession. It's been utterly corrupted by Pfizer and Pfauci, and it seems that most doctors are sniveling cowards who would murder you via NIH and CDC "guidance" rather than stand up and tell the truth about the vaxx.

As previously reported, the California legislature wants to pass a “medical misinformation bill,” aka Assembly Bill 2098. The law would ban doctors from giving medical advice and treatment not approved by the state.

Put simply, the bill bans doctors in California from criticizing vaccines and alternative treatments not approved for Covid like ivermectin and hydroxychloroquine, particularly online.

One doctor, Syed Haider, has been forced to retain a lawyer because of his support of such treatments.

“Like a lot of other doctors around the world, I’ve just been trying to raise awareness of this,” Haider told Epoch. “But, like a lot of doctors in America, I’ve gotten letters from the American Medical Association, the Federal State Medical Board warning me that my license is at risk if I speak out about vaccines or if I spread misinformation or if I prescribe ivermectin.”

Haider feels dissenting voices have been silenced since the beginning of the pandemic and he has had to retain a lawyer so that he does not lose his license. ...

“In nearly every hospital and clinic in the United States right now, it’s considered to be some form of misinformation or disinformation to say anything other than the vaccines are safe and effective,” Haider noted. “To say there are any risks associated with the vaccines is claimed to be misinformation or disinformation, and the working definition of misinformation or disinformation seems to be anything that would prevent someone from submitting to or doubting the FDA and CDC guidelines and recommendations.”


The vaxx is NOT safe and it is NOT effective.

Children and young people are dying and suffering. Many healthy elderly people have also died. We are being lied to, the group says. Health Forum New Zealand tracks all deaths and injuries after vaccinations.

These are mainly young people, even children, who died suddenly and unexpectedly, often after blood clots in the brain or heart. NZDSOS calls it a “humanitarian crisis.” “For God’s sake, let’s make sure our MPs and police put an end to this now!”

Eddie (13) from Wellington died in his sleep a few days after vaccination, Joanna (15) collapsed in her bathroom and died on the way to the hospital, Timothy (33) died of a heart attack two days after vaccination, Annabelle (38) died in September 2021 two hours after her second vaccination.

The hospital confirmed that she had died from the vaccination but forced her family to sign a vow of silence.

Maggie (47) fell ill after receiving the booster vaccination, which the coroner said she should not have received at all because she was immunocompromised. Mark (52) died suddenly in his sleep after his second injection.

Alyss (31) was urged by her family doctor to have the injection but suffered a brain hemorrhage 10 days later and died. Bodybuilder Alex (25) died in his sleep after receiving his first vaccination.

Satya from Manurewa died in her sleep after receiving the vaccine. Ana (43), also from Manurewa, died in her sleep shortly after receiving her booster. Lefty (23) suffered a fatal stroke in his sleep after his second shot.

Timothy, a healthy 60-year-old, died of a heart attack three hours after his first shot. And there are hundreds more such cases.

There was a massive decrease in the number of people applying for Social Security disability during 2020 and 2021. This decrease was caused by a massive increase in the amount of unemployment compensation provided by the Federal govenrnemt, as well as the increase in the amount of time these enhanced unemployment checks were issued. the massive amounts of PPP $ dished out and the "free" money checks sent out. Once these "free" money giveaways stopped, not only did the numbers revert to trend, but there were a couple years of reduced filers that needed to be caught up on.

You’ve totally missed the point.
So many doctors have no integrity because they knew they were killing patients with their retarded “protocol” which kept the infected home until they were too sick to function without any treatment or medicine. Then they’d stick em on a vent to finish the job and rack up another Covid kill for the administration. Oh and another $40k for the hospital.

Add this to the fact that almost every doctor was promoting and recommending the vax when it wasn’t tested properly and the adverse event signal was absolutely massive. The corporate media sold the idea that the signal through VAERS wasn’t accurate (which was actually true, it was only 2% of the true adverse events totals), and doctors used that fig leaf to hide their shame of pushing the most dangerous vax in history on their patients. I'm on the side now of "doctors: fuck them". They need to be mandated to take the vaccine. Take your own medicine "doctor". These people saw first hand what was going on, didn't speak up, and let people die. I always had a shaky view on humanity, it's 100x worse now than it was 2 years ago.

My dim view is in that complete obedience and subservience of people that surround me. 20 years ago, we weren't like that.

It's the lack of ethics that disgusts me. I would expect in Silicon Valley, where critical thinking is an absolute requirement of our jobs, that more people would exercise it. I remember when companies that engaged in blatantly unethical behavior, engineers would quit and people looking for jobs would shun them. This would correct the company's behavior. That's what happened to Microsoft, and Yahoo. People wouldn't put up with discrimination of any sort either, this was ONCE a meritocracy. That's why we did so well, and why we were the undisputed king of technology at one point.

That culture is gone.

I hear you. There are a lot of people who accept the "security" of working soul sucking jobs

As a young man I worked for the DoD at a naval shipyard as a marine machinery mechanic. Part of my job was to remove, refurbish, and replace watertight doors and hatches on nuclear fast attack subs. The job was fascinating but the environment was cruel. It seemed that most people at the shipyard cared for little but getting paid.

Coffee break started after you clocked in at 7:30 and the day ended when the time clock ticked over to 4pm and we could punch out. There were always lines of people just waiting to punch their time cards at the moment the time clocks struck four.

My last straw, as I like to work, was when we were reaching the end of the fiscal year but had not used up all of our annual man-hours. Even though there was little work to do, we were forced to be there for 12 hour days, six days a week. We clocked in at 4:30am and went to the cafeteria for breakfast. We then "hid" or did make-work until 5pm. We did get a half hour lunch. HUGE check from all the overtime, but it was soul crushing.

I eventually resigned and went back to college to study math and computer science.

I think that most people do want to do the right thing but don't know what is right or are stuck in their comfort zone and don't want to speak out.

Last month, I saw a patient, 60 y.o. male, previously very healthy, sustain a dissecting aortic root aneurysm less than 3 weeks after his 4th mRNA, that required emergency repair and mechanical aortic valve replacement.
As a physician, I believe "there could be a connection."

While hesitant to speak out at that time, (I, like so many physicians in medicine, was an employed physician for a large healthcare organization and did not feel comfortable speaking my mind.) I felt it was my moral and civic duty to give my comments and opinion in this very public forum. With the strength and support provided by Ann and my good friend, Mattie Leto, I agreed to give my testimony that THE SCIENCE failed to support the use of masks as a deterrent to the spread of viral illnesses in a community setting. There were only two randomized clinical trials [10] dealing with this topic at that time (that I was aware of) and neither showed any statistically significant benefit of masks with regard to prevention of COVID-19 [11]. I also spoke of potential harms of masking healthy, low-risk, children. It is well documented that masking can lead to developmental, learning and speech delays in young children, and anxiety and depression in older children and teens. My comments received tremendous support from the parents, students, and citizens in attendance. A very telling sign of our community’s sentiment was that only 2 people in attendance wore a mask.

During this school board meeting, I also clearly stated that if anyone could show me objective scientific data that refuted my position, I would consider said evidence and potentially change my opinion and comments. To this day no one has presented me with any data to show that masks are effective and should be used in schools. The risk of serious illness, hospitalization and death in healthy school age students is almost zero. I have never seen or heard of a documented case in this group of people. The known potential harms of masking these students, however, are quite profound. Again, tremendous downside risk comes with masking children with no benefit.

Unfortunately, those public comments got me in very hot water. Someone in our community wrote a scathing letter to our hospital CEO calling for my termination. They stated that I was impairing the community’s effort at controlling the pandemic. Keep in mind, as a physician in a medically underserved, rural community (I was and am the only fulltime physician for our county), I provide healthcare services to an area in which I have grown up and raised my family. I was actively treating patients to prevent disease and its spread, using the best available unbiased scientific evidence. And someone with no medical knowledge or experience was trying to get me fired! This was mean spirited, ignorant, hurtful and difficult for me to understand. If I were fired, there would be no one to take my place and our community would suffer. This blatant attempt at censoring my opinion and stifling the free flow of medical thought and discussion is yet another example of the widespread coercive censorship that has occurred locally, nationally, and worldwide during the pandemic.

Not long thereafter, I received a formal letter of reprimand and was instructed not to speak publicly on any medical topic without prior approval.

Ann and I continued to treat our patients aggressively with multidrug protocols achieving great success. But, in early September of 2021, I received a phone call from a local pharmacist at a chain pharmacy. He was quite apologetic but told me that “corporate” had instructed their pharmacists to no longer fill prescriptions of Ivermectin for the treatment of COVID-19. All the other big box chain pharmacies in our area had already instituted this harmful and misguided policy. This reckless act by a large corporate pharmacy put hundreds of thousands of patients’ lives at risk. There is no telling how many lives could have been saved had Ivermectin, an age-old drug with multiple studies supporting its safety and efficacy, been made readily available to physicians across this country.
