The incident began January 2, 2013 after David Eckert finished shopping at the Wal-Mart in Deming. According to a federal lawsuit, Eckert didn't make a complete stop at a stop sign coming out of the parking lot and was immediately stopped by law enforcement...

after law enforcement asked him to step out of the vehicle, he appeared to be clenching his buttocks. Law enforcement thought that was probable cause to suspect that Eckert was hiding narcotics in his anal cavity....

1. Eckert's abdominal area was x-rayed; no narcotics were found.
2. Doctors then performed an exam of Eckert's anus with their fingers; no narcotics were found.
3. Doctors performed a second exam of Eckert's anus with their fingers; no narcotics were found.
4. Doctors penetrated Eckert's anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
5. Doctors penetrated Eckert's anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
6. Doctors penetrated Eckert's anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
7. Doctors then x-rayed Eckert again; no narcotics were found.
8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert's anus, rectum, colon, and large intestines. No narcotics were found.

Throughout this ordeal, Eckert protested and never gave doctors at the Gila Regional Medical Center consent to perform any of these medical procedures.

ANOTHER SIMILAR CASE IN NM

Timothy Young is taken to the same Gila Medical Center - and the same Dog (and likely, same Handler) - and also outside the jurisdiction of the cops, and also after a routine traffic stop, this one for not using a blinker when turning.

Our investigation reveals another chapter. Another man, another minor traffic violation, another incident with Leo the K-9 and another example of the violation of a man's body.

Police reports state deputies stopped Timothy Young because he turned without putting his blinker on.

Again, Leo the K-9 alerts on Young's seat.

Young is taken to the Gila Regional Medical Center in Silver City, and just like Eckert, he's subjected to medical procedures including x-rays of his stomach and an anal exam.

Again, police found nothing, and again the procedures were done without consent, and in a county not covered by the search warrant.

We've learned more about that drug dog, Leo, that seems to get it wrong pretty often. He might be getting it wrong because he's not even certified in New Mexico.

If you take a look at the dog's certification, the dog did get trained. But his certification to be a drug dog expired in April 2011. K-9s need yearly re-certification courses, and Leo is falling behind.

"We have done public requests to find anything that would show this dog has been trained, we have evidence that this dog has had false alerts in the past," Eckert's attorney Shannon Kennedy said.

The doctors from the Gila Regional Medical Center have been turned over to the state licensing board. It's possible they could lose the ability to practice medicine.

And the police officers will be answering to a law enforcement board.

Get this: The Deputy District Attorney told the cops to go from the Demming Hospital to the Gila Medical Center.

Somebody explain to me how the Deputy DA can recommend a warrant based on such flimsy evidence, and a judge sign it? And then, the Deputy DA advises the cop to take the suspect outside the jurisdiction of the warrant. Real sloppy in NM.

Oh man, Eckert is gonna be RICH!

This will be fun to see all the special interests align to defend their members. Will the doctors have their licenses revoked (very possibly)? Will the DDA be disbarred (highly unlikely)? Will the cops be charged with crimes (almost certainly not)?

If you want to get away with shit, be a lawyer or a cop.

I learned from my time spent with a guy that trained police dogs for years, the dog is only as useful as his handler allows for him to be, so obviously these POS worthless roid tards that litter our police state rolls would suggest, the dogs are usually worse then useless

When that did not work, he was given a drug to paralyze him for 30 minutes. “Balancing these three factors [from Winston v. Lee], the Court finds that the DRE was a reasonable procedure under the circumstances and was reasonably employed, particularly given the risk to the Defendant from the drugs in his rectum for which there was a clear indication were there [Schmerber v. California] and the Defendant’s actions hindering their removal. Accordingly, the Court finds that the search in question did not violate the Defendant’s Fourth Amendment rights.”

Not relevant. Suspect was already arrested and in jail, and there was obviously something pertruding from his rectum. This guy had nothing pertruding from his rectum, nothing in his stomach, even after three enemas, multiple cavity searches, and a colonoscopy.

Until I obtain three (3) consecutive stool samples, the results of three rubber-glove exams, an x-Ray, and finally a colonoscopy, I figure your insides are full of heroin and meth.

A few years ago I was driving in SoCal, from Orange County to Palmdale (please don't judge me!); I was stopped at Mulholland. I have Utah plates & it was a Monday night, traffic was going about 75mph & I was a little slower, going 70.

There were grooves in the concrete road that tossed my little car around a bit and I was pulled over. The officer asked me how much I had drank, where I was coming from, where I was going, names of who I was with before, names of who I was going to see. Then he shined a light in my car and asked me what was in the bag in the back seat - it was my crocheting.

He asked these questions several times, several ways. Even asked addresses. I didn't know my sister's address in Palmdale but knew the street and told him that. He asked me how I knew I was in the right place when I got there if I didn't have an address and I told him my sister hadn't mowed her lawn in so long it now qualified as a nature preserve.

He was obviously disappointed and let me go (finally); he told me that if I had been going the speed limit he would have pulled me over for impeding traffic. He fucking profiled me!

I wasn't on a road to Utah, it was a Monday night, he thought he found a drug runner and instead he found a boring mom from Utah.
