Hillary is guilty as it gets.

The relevant federal statute regarding accessing, forwarding, taking custody of and disseminating classified documents requires NO INTENT TO DO SO (even though a competent prosecutor could easily prove Hillary had such intent).

As a very famous and effective defense lawyer once said, the threshold for indictment is so low that federal prosecutors "could indict a ham sandwich" if they chose to do so (though Hillary really did break serious federal law).

This is clearly a case of Hillary being treated as if she's above the law.

The politically-motivated, highly partisan DOJ, under Loretta Lynch didn't want to do ANYTHING to hurt Hillcriminal's chances of being elected, so Lynch essentially quashed the whole thing,'using the FBI and Comey as the fall guy.

18 U.S. Code § 793 - Gathering, transmitting or losing defense information

(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—
Shall be fined under this title or imprisoned not more than ten years, or both.

(g) If two or more persons conspire to violate any of the foregoing provisions of this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.
(h)
(1) Any person convicted of a violation of this section shall forfeit to the United States, irrespective of any provision of State law, any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, from any foreign government, or any faction or party or military or naval force within a foreign country, whether recognized or unrecognized by the United States, as the result of such violation. For the purposes of this subsection, the term “State” includes a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.
(2) The court, in imposing sentence on a defendant for a conviction of a violation of this section, shall order that the defendant forfeit to the United States all property described in paragraph (1) of this subsection.
(3) The provisions of subsections (b), (c), and (e) through (p) of section 413 of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21 U.S.C. 853(b), (c), and (e)–(p)) shall apply to—
(A) property subject to forfeiture under this subsection;
(B) any seizure or disposition of such property; and
(C) any administrative or judicial proceeding in relation to such property,
if not inconsistent with this subsection.
(4) Notwithstanding section 524(c) of title 28, there shall be deposited in the Crime Victims Fund in the Treasury all amounts from the forfeiture of property under this subsection remaining after the payment of expenses for forfeiture and sale authorized by law.

Loretta Lynch deferred the case to the FBI to investigate and compile a report regarding whether to file charges (unprecedented in and of itself).

Lynch and the DOJ were never going to indict Hillary but wanted political cover, and found it in Comey.

Any competent prosecutor could have successfully prosecuted Hillcriminally under section (f).

Hillary, who kept a private fucking server in her fucking basement where she kept hundreds of thousands of state department docs, many which were sensitive, classified, or even top-secret...

While the government tends to seriously over-classify documents, in part to make them immune to Freedom-of-Information requests, it is not a defense to say I did not think that document classified Secret was all that Secret.

Or you mean his actions against advice and precedent look like he was meddling rather than sincere especially given that a computer check of the emails in advance would have demonstrated that they were almost entirely duplicates and showed nothing new. Instead he blundered straight into it knowing that it would negatively impact the chances of one candidate and most importantly, did so without any actual proof of wrongdoing. That shows him to either be an individual with extraordinarily poor judgement or outright bias. Either way, it doesn't look good for a man heading up the FBI.

As a general rule, until things get to court one shouldn't pay too much mind. If there are convictions, well, that ain't nuthin'. So far Clinton's nuthingburgers just piss off the wingers no end, but right-wingers continually suffer reality friction. It's pretty much their constant condition, but their only answer is to assail and deny reality. We're used to that, for sure. There are convictions to be had elsewhere. Where though? Christie's crew, for example. Four people have testified that he knew about all of it. But that's bias. That's rigged. Losers gonna lose. Losers gonna whine.

Sorry to break your anti hillary ranting bubble but non classified government documents are public property. Anyone can have them anywhere in any format. Most people have to request them using FOI, but there isn't any law that says you can't have them no matter how they got there.
