Hillary is guilty as it gets.
The relevant federal statute regarding accessing, forwarding, taking custody of and disseminating classified documents requires NO INTENT TO DO SO (even though a competent prosecutor could easily prove Hillary had such intent).
As a very famous and effective defense lawyer once said, the threshold for indictment is so low that federal prosecutors "could indict a ham sandwich" if they chose to do so (though Hillary really did break serious federal law).
This is clearly a case of Hillary being treated as if she's above the law.
The politically-motivated, highly partisan DOJ, under Loretta Lynch didn't want to do ANYTHING to hurt Hillcriminal's chances of being elected, so Lynch essentially quashed the whole thing,'using the FBI and Comey as the fall guy.
all this means is Mr. Comey will sell newspaper on the streets when Trump is president.
18 U.S. Code § 793 - Gathering, transmitting or losing defense information
(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—
Shall be fined under this title or imprisoned not more than ten years, or both.
(g) If two or more persons conspire to violate any of the foregoing provisions of this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.
(h)
(1) Any person convicted of a violation of this section shall forfeit to the United States, irrespective of any provision of State law, any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, from any foreign government, or any faction or party or military or naval force within a foreign country, whether recognized or unrecognized by the United States, as the result of such violation. For the purposes of this subsection, the term “State†includes a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.
(2) The court, in imposing sentence on a defendant for a conviction of a violation of this section, shall order that the defendant forfeit to the United States all property described in paragraph (1) of this subsection.
(3) The provisions of subsections (b), (c), and (e) through (p) of section 413 of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21 U.S.C. 853(b), (c), and (e)–(p)) shall apply to—
(A) property subject to forfeiture under this subsection;
(B) any seizure or disposition of such property; and
(C) any administrative or judicial proceeding in relation to such property,
if not inconsistent with this subsection.
(4) Notwithstanding section 524(c) of title 28, there shall be deposited in the Crime Victims Fund in the Treasury all amounts from the forfeiture of property under this subsection remaining after the payment of expenses for forfeiture and sale authorized by law.
(June 25, 1948, ch. 645, 62 Stat. 736; Sept. 23, 1950, ch. 1024, title I, § 18, 64 Stat. 1003; Pub. L. 99–399, title XIII, § 1306(a), Aug. 27, 1986, 100 Stat. 898; Pub. L. 103–322, title XXXIII, § 330016(1)(L), Sept. 13, 1994, 108 Stat. 2147; Pub. L. 103–359, title VIII, § 804(b)(1), Oct. 14, 1994, 108 Stat. 3440; Pub. L. 104–294, title VI, § 607(b), Oct. 11, 1996, 110 Stat. 3511.)
Look at (f) jackass.
Gross negligence is the standard under (f), and each of these sections has a different standard re intent, negligence, etc.
[Comey] said he was able to locate just one case prosecuted under the "gross negligence" provision of 18 USC 793 in the century since the law was passed, which shows federal prosecutors "have grave concerns about whether it's appropriate to prosecute somebody for gross negligence."
Loretta Lynch deferred the case to the FBI to investigate and compile a report regarding whether to file charges (unprecedented in and of itself).
Lynch and the DOJ were never going to indict Hillary but wanted political cover, and found it in Comey.
Any competent prosecutor could have successfully prosecuted Hillcriminally under section (f).
Hillary, who kept a private fucking server in her fucking basement where she kept hundreds of thousands of state department docs, many which were sensitive, classified, or even top-secret...
It's all FUCKING RIGGED.
It's all FUCKING RIGGED.
RIGGED!! BENGHAZI!! DEATH PANELS!! EBOLA!! SKEWED POLLS!! KENYA!! You losers always have some bullshit reason why someone else is to blame for you being losers.
It's useless.
Don't bother.
His/Its brain is a jellified, contorted, half-melted partisan blob.
My argument is that you have no proof that Comey was trying to sabotage the elections.
Well, that he was advised by literally EVERYONE not to release his letter saying the investigation was open again would be a starting point...
that apparently he sent this with literally ZERO info that anything on that computer had to do with Hillary is a good second point.
that there is an actual rule that the FBI will be extremely careful not to influence elections is point 3...
ironpussy, better start deleting all your posts about how trump is winning... just like you deleted all the "rmoney winning" ones!
wow you are such a fucking coward, even online!
Well, that he was advised by literally EVERYONE not to release his letter
Then what was there for him to do it?
No, I can't be bothered, neither there is need to. We established that your statement about Comey is just a subjective opinion. Therefore, I am entitled to a subjective opinion that it is wrong.
Except his subjective opinion is based on the actions of Comey. Yours is based on...

the actions of Comey
While the government tends to seriously over-classify documents, in part to make them immune to Freedom-of-Information requests, it is not a defense to say I did not think that document classified Secret was all that Secret.
Or he's just sincere in keeping the public appraised of the email situation, realizing the attorney general interfered in July in not letting him proceed with the grand jury angle he so desperately wanted and would be willing to sacrifice his career to get out the truth.
Or you mean his actions against advice and precedent look like he was meddling rather than sincere especially given that a computer check of the emails in advance would have demonstrated that they were almost entirely duplicates and showed nothing new. Instead he blundered straight into it knowing that it would negatively impact the chances of one candidate and most importantly, did so without any actual proof of wrongdoing. That shows him to either be an individual with extraordinarily poor judgement or outright bias. Either way, it doesn't look good for a man heading up the FBI.
You said his actions could be interpreted in different ways, so give us your interpretation.
But my interpretation, apart from the fact that such is permissible, is an entirely different topic. As I wrote earlier, I can't be bother to explain further.
“If [Hillary Clinton] thinks she is clean, then tell everybody around her to go ahead and stop pleading the Fifth. Come to Congress and tell us the truth." — Congressman Jason Chaffetz

You have to laugh.
“If [Hillary Clinton] thinks she is clean, then tell everybody around her to go ahead and stop pleading the Fifth. Come to Congress and tell us the truth." — Congressman Jason Chaffetz
Telling everyone around her to stop pleading the fifth would be the absolute dumbest thing she could do. But I'm not surprised that pissant Chaffetz is whining for it to happen. The GOPers have been worshipping Clintons for decades and it's been worth fuck all. They would be happy to subpoena her bathwater if it kept them from doing their jobs as lawmakers and enabled them to empanel yet another pointless kangaroo hearing circle-jerk of weeping self-important Chicken Littles. In the event she wins they are already planning four more years of wasted taxpayer-funded witch hunts that will lead to nothing but taxpayer-funded witch hunts. First a black man and then a non-man. Do you really think they need MORE assistance in the obstruction that has trashed their approval rating with the American electorate? More?

Wow you believe that? All the smoke coming from the Clintons does not indicate any fire?
I knew the trolls would eventually get to Iwop...

Y'know, back when he was the Font of All Wisdom before he came under intense internal pressure
Ok. We are in agreement.
Or you mean
hisher actions running classified documents on a personal server against advice and precedent look likehe was meddlingshe was dealing
Wow you believe that? All the smoke coming from the Clintons does not indicate any fire?
LOL. Read this: http://www.huffingtonpost.com/entry/edward-snowden-hillary-clinton-emails_us_581fe27de4b0aac62485334d
Snowden, of all people, explains why investigations that take so long, over and over, are more about producing smoke than fire. I believe that Clinton has been around so long that she gives a target rich environment to lunatic right-wingers who have to blame someone for losing so many of the last popular votes for President. The GOP and the right cannot win the battle for demographic change in America if they don't change. Rather than change and improve their chance of winning they prefer to build fires and point at the smoke. They get paid well to do it, and fools believe what they say.
So Glad the Russians turned off their Mind Control Rays yesterday.
Snowden, of all people, explains why investigations that take so long, over and over, are more about producing smoke than fire.
Bullshit. More likely it is because the Clintons are trained lawyers and know how to manipulate and skirt the law. The allegations have been going on for decades.
Which is exactly why he put me on ignore
And you actually care, which is against the advice of every major religion, philosophy and doctrine of psychology.
If you read the Pali Canon (Buddhism) or the Bible, made notes, and strived to live completely antithetically to their guidelines, you couldn't do a better job than you're doing now.
You're basically anti-Jesus.
The allegations have been going on for decades.
It's not about anything but making allegations and blowing smoke, otherwise they'd have to resort to...gasp...governance and...gasp...compromise with a...gasp...black man or a...gasp...female. The only reason there has been only eight years of birtherism is because they didn't know about Obama before then. They've had decades to worship Clinton to practice their incompetence so they've written hundreds of novels with rivers of ink and oceans of time that you gladly pay for simply in order to achieve.....fuck all. Whitewater. Vince Foster. It's all they're good for and they know it so back to the well they go. And you'll pay them to do it. And if the #DoucheBag loses you'll pay him and his idiot spawn for decades to talk about it further. Who knew you were willing to pay so much for so long just for smoke and allegations with nothing to show for it? You've got them right where they want you.
Wow you believe that? All the smoke coming from the Clintons does not indicate any fire?
So far, after all these years, all the smoke was emanating from the cigar Bill stuck up Monica's zorch. Most delightful I'm sure
It's not about anything but making allegations and blowing smoke
Including Bill's impeachment?

The Teflon Dona. With enough money you're never guilty in this country.

It sure works for Trump so far.
As a general rule, until things get to court one shouldn't pay too much mind. If there are convictions, well, that ain't nuthin'. So far Clinton's nuthingburgers just piss off the wingers no end, but right-wingers continually suffer reality friction. It's pretty much their constant condition, but their only answer is to assail and deny reality. We're used to that, for sure. There are convictions to be had elsewhere. Where though? Christie's crew, for example. Four people have testified that he knew about all of it. But that's bias. That's rigged. Losers gonna lose. Losers gonna whine.

Weiner's unwarranted possession of State Emails, which he had NO BUSINESS having on his machine (inc. the non-classified ones - why are they on his machine at all?)
Sorry to break your anti hillary ranting bubble but non classified government documents are public property. Anyone can have them anywhere in any format. Most people have to request them using FOI, but there isn't any law that says you can't have them no matter how they got there.
Thunderlips Russian Agent 0069 says
That he decided not to recommend prosecution, despite the fact that the sending of classified emails and storing them on an unapproved server does not require intent, back in July.
Feel free to write him and explain how you understand federal law better than the director of the FBI.

Do you know none of them were classified?
It's funny, but Clinton didn't like it when Wikileaks put out non-classified State Emails and called Assange a criminal.
It's still a security leak and it deserves to be fully investigated.
Feel free to write him and explain how you understand federal law better than the director of the FBI.
Oh, I see the Russian Mind Rays were switched off and Comey is back to being a Rule of Law defender instead of an enabler of RACIST! TRUMPLAND! rogue FBI agents.
